Real estate policy means directives or behavior patterns to solve or to improve on the problem about real estate. However real estate policy is not the scientific terms. Usually land policy, housing policy, and urban policy are contained in the terms of real estate policy. By the way, the common sense of our present society is that price stabilization of real estate is a like terms of real estate policy. The primary doctrine of capitalism is that goods’ price depends on only market order, nevertheless, the reason why the government intervenes in real estate's market is that there are many logics - constitutional ideology, political issue, and economic problem. Because of the reasons like above, the government positively intervenes in real estate market in spite of ‘Government Failure’.Until now, the pattern of government intervening in real estate market has been the style of central government-initiated. Therefore, at present we have to be concerned about local self-government’s role related to intervene in real estate market. Ist die Steuer als Instument fr Spekulationsregulierung geeignet? Die Steuer kann zwar dem Lenkungszweck dienen. Da gibt es aber eine Grenze. Fr die koreanische Regierung ist die Spekulationsregulation seit lngerer Zeit hoch interessant. Gegen spekulative Geschfte ber Grund und Boden hat die Regierung mit der Besteuerungsmethode gekempft. Dies ist allerdings zum Ergebnis gekommen, dass das Gesamtsteuersystem ungeheuer verkompliziert worden ist. Die Steuer ist auf keinem Fall einziges Instrument, mit dem die Spekulationstendenzen erheblich reguliert werden kann. Nicht außer Betracht bleiben darf allerdings, dass die Steuer ihre eigene Stellung im Gesamtrechtssystem wieder finden muss. Zu diesem Punkt ist ergnzend zu bemerken, dass die Lsung der Grundstcksspekulationsproblem nicht nur Besteuerung, sondern auch viele andere Methoden braucht. This paper is aimed at reviewing policy tasks and roles of governments according to environmental changes in the field of real estate in Korea. The 2000s experience various environmental changes, including structural changes in land and property market, linkage of land and property market and finance market, openness of real estate market, changes in local governance and development of informational technology. Policy tasks which deals with such situations are as follows: Firstly, the public concept of land and housing should be strengthened. Secondly, the coordination system of real estate policy should be rationally established in consideration of new local governance. Thirdly, the transparency of real estate market should be strengthened by establishing an integrated land and property information system. Das Ziel der Verwaltung liegt in der Vermehrung des Allgemeinwohls. Fr dieses Ziel zu erreichen soll die Verwaltung einheitlich handeln. Sie ist darum hierarchisch aufgebaut. Um die Koordination und Vereinheitlichung der Verwaltungsttigkeit der Verwaltungsbehrde zu ermglichen, ist die Aufsicht der hheren Behrden ber die nachgeordneten Behrden notwendig. Es ist zuerst ber das Verwaltungsstruktur der koreanischen Verwaltung zu untersuchen. Sie ist in unmittelbare Staatsverwaltung und auch mittelbare Staatsverwaltung einzuteilen. In dieser Untersuchung ist die Studie auf die unmittelbare Staatsverwaltung zu konzentrieren. Die rechtliche Aufsicht kann in drei Arten gegliedert werden, nmlich die Rechtsaufsicht, die Fachaufsicht und auch die Organaufsicht. Diese Arten der Aufsicht sind durch die Intensitt der Aufsicht der hhrern Verwaltungsbehrden ber die unteren Verwaltungsbehrden zu unterscheiden. Rechtsaufsicht bedeutet, daß die Aufsicht auf eine Rechtmßigkeitskontrolle beschrnkt ist. Die Fachaufsicht geht ber die Rechtsaufsicht hinaus und berechtigt zur Kontrolle und Steuerung der Zweckmßigkeit des Verwaltungshandelns. Die Organaufsicht erstreckt sich zustzlich auf die Personalangelegenheiten sowie auf den Aufbau, die innere Ordnung und die allgemeine Geschftsfhrung der Behrde. Die der hheren Verwaltungsbehrde zur Verfgung stehenden Aufsichtsmittel sind Informationssammlung, Beanstandung, Anordnung, Ersatzvornahme, Genehmigungsvorbehalt, Anzeigevorbehalt usw. Die koreanische Verfassung hat Kommunalselbstverwaltung im Kapitel der Kommunalselbstverwaltung(in gegenwrtiger Verfassung, Kapitel 8. Art. 117 und 118) gewrleistet seit 1948. Wegen der politischen Situationen wurde aber fr lange Zeit Kommunalselbstverwaltung ungesetzt. Seit 1991 wurde die koreanische Kommunalselbstverwaltung wieder neu in Gang gesetzt. In der Republik Korea werden die Gemeinderte von den Brgern gewhlt. Seit 1995 wurde endlich Kommunalsdirektor von den Brgern gewhlt. Daher kann man jetzt schon sagen, daß es in Republik of Korea volle Kommunalselbstverwaltung herrscht. In koreanische Kommunalselbstverwaltung gibt es aber auch viele Probleme. Die Gemeinderte(Mitglieder des Gemeinderates) sind die aus allemeinen, unmittelbaren, freien, gleichen und geheimen Wahlen hervorgegangenen Gemeindevertreter. Die Mitgliederzahl richtet sich (meistens) nach der Einwohnergrße.Der Gemeinderat ist die Vertretung des Volkes in diesem Sinne. Er ist aber trotz Bestehens gewisser parlamentstypischer Merkmale kein Parlament i.S.d. Gewaltenteilungslehre, sondern ein Verwaltungsorgan. Dies gilt selbst dann, wenn er Recht setzt. Er ist die politische Vertretung der Brgerschaft. Er legt Grunstze fr die Verwaltung der Gemeinde fest und entscheidet im Rahmen der kommunalen Verbandskompetenz ber alle politisch, rechtlich, wirtschaftlich oder in sonstiger Beziehung wichtigen und grundstzlichen Angelegenheiten der Gemeinde, soweit nicht kraft Gesetzes ein anderes Gemeindeorgan, speziell die Verwaltungsleitung zustndig ist. A Study of the Housing Laws in JapanThis thesis studied about the idea and directions inside the Housing Laws in Japan which had a great effect on establishing the Housing Laws in Korea, including the Building Law, the Urban Planning Law, the Korea Housing Corporation Law and the Housing Law. The Housing Laws of Japan are characterized by two ; first, all the people are divided into fine, medium and poor by income, and based on such income level the Public Housing Law, and the Housing Park Law, etc are applied to different people the three staged law system, and second, with the housing construction planning law enacted in 1966 all housing related laws have formed the present Housing Laws of Japan, unified and integrated by the five-year plan for housing construction.To conclude, as in the case of periodic speculation in housing in Korea, where the reasonable housing laws haven’t been established yet, the Housing Laws of Japan show that they’re building very systematic, unified and effective laws to achieve the purposes of housing policy, given their own economic and social setting.(주제어) 주택, 주거권, 주택법, 주택금융, 주택세제, 임대주택, 주택건설

The Korean law-system permits ex-owners of expropriated estate the redemption right to buy it back preferentially when the purpose of land expropriation is expired or given up. According to majority view of scholars that is a public right based on public law and therefore to be brought to an administrative litigation in case of violation. It is generally thought that this redemptive right is derived from the clause of property right on Article 23. in Korean Constitution. Recently many korean scholars begin to insist that the new idea about property right which firmly guarantees the continuation of property endorses redemptive rights of ex-owners. Fr die Beurteilung von Machtverhltnissen in der Gesellschaft findet man in der Soziologie kein ausreichendes empirisch gesichertes Wissen und keinen Konsens der Fachleute. Fr die meisten Probleme im Zusammenhang mit Machtbildung, Machtsteigerung, Machtverteilung, die ich anschnitten habe, gibt es gegenwrtig kein empirisch gesichertes Wissen, und dies ist nicht einfach nur ein bald zu behebende Mangel, sondern ist mitbedingt durch die Komplexitt der Problemlage. Daher kommt die Soziologie `ber Analysevorschlge und diagnostische Mutmaßung nicht hinaus. Wer mehr behauptet, wird sich auf eine rasche Zersetzung einer Thesen durch Kritik gefaßt machen mssen. Aber die Alternative kann nicht heißen : Wissen oder kein Wissen. Auch Analyseinstrumente haben einen unterschiedlichen Grad von Bewhrung und unterschiedliche Anschlußfhigkeit fr Forschung und Praxis. Sie mssen ausreichend komplex sein, um berhaupt etwas besagen knnen. The introduction of surcharges system in Korea was included in Monopoly Regulation and Fair Trade Act established in 1980. This surcharge system has been influenced by the Japanese counterpart, which imposed on the cartel for the rise in price of the entrepreneurs. However, we have expanded and adopted variously in individual laws not only the subjects of the levy on surcharges through the reform of MRFTA since 1980s, but also the surcharges system itself. In this aspect, there have been many discussions in regards of the surcharges system. This study defines the legal characteristics of the surcharges system and discusses the presence of violation for the constitutional doctrine of double jeopardy taking place due to the levy on fines and administrative penalty or parallel levy on administrative penalty.(주제어) 과징금, 독점금지, 불공정거래, 이중처벌금지, 행정강제, 경제규제

Taxation is to begin to have important meaning particularly as the main source of national financial revenues since the state of despotic monarch was ruined and modern civil society was formed.After that, up to the period of contemporary administrative nation, tax is recognized as the conflictive question of interests with the people, financial demand grown immensely.For these reasons, most of the nations accept the principle of a constitutional state which consists of ‘no tax without representation’ and ‘the principle of equality of taxation’ as basic idea of the tax law.Therefore, this treatise is to progress to study on how the principle of a constitutional state which is as a basic idea in constitutional law is realized in the tax law, in view of answering the voice of civil society requiring the justice of taxation lately according to the order as follows. First of all, in the 1st chapter, I raised a question and in the 2nd chapter, I inquired into the contents of the principle of a constitutional state in the tax law that focused on ‘no tax without representation’ and ‘the principle of equality of taxation’.Also in the 3rd chapter, I considered the limitation of the right of taxation and in the 4th chapter, I progressed to describe the conclusion as the completion of this study. Zustandsverantwortlich werden Personen, wenn von Sachen oder Tieren, ber die sie die tatschliche Gewalt oder an denen sie das Eigentum haben, Gefahren ausgehen. Neben der Zustandsverantwortlichkeit ist auch die Handlungsverantwortlichkeit zu nennen, wenn Personen durch ihr Verhalten die Gefhrdung oder Strung der ffentlichen Sicherheit oder Ordnung verursachen. Die beiden Verantwortlichkeiten knpfen an anderen Gefahrenquellen an. Die erste erfasst Gefahren, die vom Zustand einer Sache ausgehen, indem die letztere durch das Verhalten von Personen verursacht worden sind. Daraus folgt ein Grundunterschied zwischen der Polizeipflichtigkeit des Verhalten- und Zustandsstrers. Die Zurechnung der Zustandsverantwortlichkeit erfolgt durch die Sachherrschaft, also die Beziehung eines Individuums zur Sache, whrend der Zurechnungsgrund der Handlungsverantwortlichkeit in der individuellen Kausalbeziehung zwischen dem Verhalten und der Gefahr liegt.Das deutsche Bundesverfassungsgericht hat in seiner Entscheidung vom 16.2.2000 klargestellt, dass die Zustandsverantwortung als Verpflichtung des Eigentmers zur Gefahrenabwehr oder Strungsbeseitigung die durch Art. 14 Abs. 1 S. 1 GG geschtzten Rechtspositionen berhrt. Das verfassungsrechtlich gewhrleistete Eigentum ist in diesem Zusammenhang durch Privatntzigkeit und grundstzliche Verfgungsbefugnis des Eigentmers ber den Eigentumsgegenstand gekennzeichnet. Auch ber die Grenzen der Zustandsverantwortlichkeit hat das Verfassungsgericht durch die Verhltnissmßigkeitsprfung eine Lsung versucht.Die hier ausgefhrten Theorien und Rechtsprechungen ber die polizeiliche Verantwortlichkeit, die unsere Gesetzgeber und Rechtswissenschaftler bisher relativ vernachlssigten, knnten hoffentlich dazu beitragen, polizeiliche Probleme hierzulande zu lsen.

Generally, social right is defined as an inalienable rights approved under the social law. It means the right to ask the government to secure requirements for human life. Actually, it seems to be abstract on one hand but it is explained the idea in the concrete on the other.This study discuss the intrinsic attribute of social right and tries to find out its legal character.
