    An Analysis of the Land Transaction Permit System and Its Improvement

    Abstract
    Recently the land transaction permit system which was introduced to prevent speculative land transactions of land has attracted interest from policy-makers and academics in Korea. This interest raises questions about how to improve the effectiveness of the system. This paper is aimed at suggesting the policy directions for improvement in the permit system.The major policy implications are summarized as follows: Firstly, this study proved that a more clear criterion for designating land transaction permit zones will be needed in the current permit system. Secondly, this study suggests several policy directions for improving the permit system in relation to its operation at local level. Building a more effective land transaction permit system is very important mainly because speculative land transactions of land in development areas are still dominant.

    A Study on the Tax Law Regarding Reconstruction

    Abstract
    With a sudden rise of the housing prices in Gangnam district of Seoul and the New Urban Area in the capital region as well as housing shortage in the capital region, housing reconstruction and redevelopment of residential areas became focal interests of prospective home buyers. Particularly the sudden rise of the housing prices in the areas of reconstruction and redevelopment is pointed out as a factor of the rapid increase of the housing prices in Gangnam district of Seoul. In relation to the redevelopment of residential areas and housing reconstruction projects, the transactions between the Housing Maintenance Project Association and the members of the Association generated complex tax issues and produced disputes over interpretation. Complicate tax issues on the redevelopment of residential areas and housing reconstruction projects resulted from ambiguous characteristics of the Housing Maintenance Project Association, lack of tax regulations, and complexity of tax regulations regarding reconstruction control. In addition, a differential heavy tax of capital gain tax for the Association members' retainment of housing rights as well as dual taxation of high-rate reconstruction charge and a capital gain tax has potentially unconstitutional. Therefore, it is needed to improve a relevant legislation.

    Abstract
    Governance means different thing, but the concept generally relates to group decisionmakings to address share problems.     Legal problems of Police Investigation

    Abstract
    Police aims to secure the public peace and order and police investigation has been executed as its subsidiary means. In particular, powerful administrative examination like police investigation may infringe on man's basic rights such as freedom of residence and business and privacy and it may result in illegal collection and disclosure of private information and business secret of enterprises.This study examines concept, legal basis, type and limit of police investigation based on legal principles and seeks the suggestions to Korea by examining legislature cases of police in America and Germany. Further, it reviews legal problems including prior procedures of police investigation by the existing law, limit of discretion, application of writ, application of right to refuse statement, exercising force on police investigation and injust police investigation and aims to secure efficiency of police investigation system.

    Abstract
    Im koreanischen Vergaberecht sind keine rechtlichen Grundlagen vorhanden, die die Rechte der Lieferteilnehmer schtzen. Der einzige Schutz fr Lieferanten werden bei ffentlichen Ausschreiben mit Widerspruchserhebung (Art.28) und Schiedsgericht fr internationale Vertragsstreitigkeiten (Art. 29) gewhrleistet. Wenn man dieses Thema mit den deutschen Rechtsverhltnissen vergleicht, zeigen auch die Prfungseinrichtungen viele Probleme, wie in den Punkten wie Eigenstndigkeit, Neutralitt, Verfahrensgewhrleistung, Ganrantie, Bindungsrahmen des Entschlusses und Effektivitt. Fr ffentliche Auftrge, die auch internationale Bestellungen miteinbegreifen, sind Prfungen auf Justizebene wie das Gericht oder externe Einrichtungen notwendig. Fr eine Errichtung eines vorteilhaften Strukturs und fr die Garantierung des Verfahrens zeigt bis nach den jetzigen Untersuchungen das deutsche revidierte ffentliche Vergaberecht viele Vorteile.Im deutschen Recht werden auch bei der Auftragsvergabe und Vertragsausfhrung unrechtmßige Beispiele mit Maßnahmen vorgestellt, die fr die Verbesserung der Rechtsverhltnisse bei ffentlichen Vergaben und bei der Korruptionsbekmpfung beitragen knnen.

    Problems and Advance-Oriented Directions of Taxation System on Religious Organizations

    We would have to ask if there is indeed a fair and logical tax system between a honest sincere religious organization and a religious group that is rather involved in profit-seeking or political activities. Since these religious organizations usually do what we call a public service done on behalf of the government, we believe it's fair for them to be tax exempt. However, these organizations enjoy unlimited freedom of tax exemption once they are permitted as a religious corporation from the government regardless of their activities beyond its intended purpose.Instead of giving them across the board tax exemption from the beginning, it would be much more desirable to classify religious organizations as any other, holing them liable to taxation until later date when a tax-exemption is given. The law then must be revised from none taxation to approval system of tax exemption. If each group is reviewed and examined carefully, a more logical and fair tax system can be expected.Accordingly, the study focuses on reviewing current tax laws related to religious organizations and possible loopholes of the legal system and tries to suggest better ways to deal with religious organizations whether they should be taxed or not.The study also attempts to debate the matter further in Korea by comparing American religious groups where they are subject to approval system of tax exemption.

    No one doubts that high technology is the most important driving force of national development. The direct main bodies who can carry out research and development of technology functionally are enterprises, institutes, and universities(professors). Therefore, policy makers have to get obstacles of R&D promotion out of the way. Especially they should seek to obstructions of R&D promotion in tax law and revise regulations related to tax credit or deduction of R&D cost. In this article, I pointed out several problems interrupting R&D promotion under current Korean Individual Income Tax Act, Corporation Income Tax Act, and Act of Limit Reduction & Exemption Tax. And also, I proposed several solutions for revising regulations of current tax statutes.

    A Study on the Bio-information protection law

    Abstract
    Bio-information is information on unique physical characteristics and behavioral traits of an individual which recognize directly that individual like fingerprint, signature, blood vessel pattern, face, voice, iris, gene, etc. Because bio-information consistently and directly recognizes a person through itself, the protection of bio-information is very important. Moreover, unlike other information such as name, address, personal identification numbers(PINs), password, bio-information has extraordinary nature that it is not able to be changed and that it is in combination with that person while living. Then, biometrics is the automated technique of measuring a physical characteristic or personal trait of an individual and comparing that characteristic or trait to a database for purposes of recognizing that individual. Biometric scanning is also used for verification, which involves the authentication of a person's claimed identity from his previously enrolled pattern. Simultaneously, to solve or prevent against problems caused by development of biometric technologies, we also must research and review cases and legislations of each country in connection with bio-information and prepare adjustment of our related legislations to harmonize these regulation approach. Recently, adjustment of legislations on collection and utilization of bio-information is so important theme, as a matter of course. But, because, until now, there are few countries which have completed legislations on bio-information protection, a wide variety of comparative studies on the protection of bio-information as personal information are necessary. We have to perform research and development to introduce and foster biometric technologies as well as standardization of biometric technologies while adjusting our related legislations on collection and utilization of bio-information.

    Principles and Regulations on Convergence of Broadcast and Communications

    Abstract
    This article is to seek the concept of broadcast, communications, and the convergence and observe the basic principles which should be covered to regulate the convergence and analyze concrete cases of new media such as IPTV and DMB. Consequently it should be noted that concrete regulation about convergence should be set up in order to be complete in principle of the social nation and the cultural nation. When the convergence is regulated under the constitutional principle, it should be referenced to public interest and universal service as a concrete rationale. In principle, it is appropriate that special act on convergence of broadcast and communications should be set up and regulated and recognized as a third type, not any more traditional broadcast and communications. If it is difficult in short time, the current broadcast act should be amended to broaden the boundary of broadcast alternately. In conclusion, the speed governing broadcast and communications is very high so that the regulation should be flexible to cover it.

    The Korean Constitution and Referendum: A Critical View de lege ferenda

    Abstract
    Referendum, as a means of direct democracy, has been useful in ameliorating some crises and in resolving some questions that established representative institutions could not manage.There are two kinds of referendum in the Korean Constitution. The one is a referendum on important policies relating to the national destiny(Art. 72); the other is one on amendment of the Constitution(Art. 130). In view of representative democracy, the latter is desirable; the former is even very dangerous because it could undermine the democratic function of the National Assembly. The author suggests an abrogative referendum be proper to the Korean constitution on the ground that it doesn't replace representative democracy but complement it. Moreover, it can be a weapon that takes control of the referendum away not only from the government but also from the political class.

    Pr?fungssystem zur Sicherung der Feuerungsanlagen in deutschem Verwaltungsrecht

    Abstract
    In der modernen verwaltungsrechtlichen Tendenz gezeigt wird, dass es einerseits, Aufforderung der Deregulierung, andererseits Notwendigkeit der Verstrkung der verwaltungsrechtlichen Beschrnkung zur Sicherung gibt. Insbes. sind Feuerungsanlagen zwar ihre Effektivitt groß, aber enthalten auch großes Gefahrenpotential. Da die Sicherung von Feuerungsanlagen eine dringende bzw. wichtige Aufgabe des Verwaltungsrechts darstellt, ist das Prfungssystem der Feuerungsanlagen von Bedeutung, um deren Sicherung zu garantieren.In Deutschland ist das Prfungssystem der Feuerungsanlagen wie Dampfkesselanlagen und Druckgert generell in dem Gerte- und Produktsicherheitsgesetz (GPSG) sowie BetrSichV geregelt. In dem Gerte- und Produktsicherheitsgesetz vorbehalten sich Feuerungsanlagen als sog. berwachungsbedrftige Anlage Erlaubnis. Ferner werden berwachungsbedrftige Anlagen von zugelassener berwachungsstelle und befhigter Personen geprft, wobei die Prfung prinzipiell durch zugelassene berwachungsstelle mit Ausnahme der Sonderregelungen im BetrSichV durchgefhrt wird. Die Prfungen teilen sich in 3 Arten, also Prfung vor Inbetriebnahme, wiederkehrenden Prfungen und außerordentlicher Prfungen. Die prfungsbezogenen Vorschriften erlegen Anlagenbetreiber zahlreiche Pflichten und verwaltungsrechtliche Strafe gegen Pflichtverletzungen zur Sicherung der Wirksamkeit auf.Das Thema “Sicherung der Feuerungsanlagen” muss man mit dem Gedanke “in dubio pro securitas” betrachten. Somit wre es besser, wenn das Prfungssystem der Feuerungsanlage mit dem Blickwinkel des “Sicherheits-vor-allem” Prinzips bzw. Gefahrenabwehr nicht mit dem Gedanke der Deregulierung erweitert und verstrkt wird.

    Improvement of the Legislation System to manage the Government R&D Performance

    Abstract
    In this Article, we will explore how governments can best achieve a legislation system to manage efficiency the government R&D performance. In order to examine the legal system of the government R&D, it is essential to understand the current acts and guidelines of management system for the government performance. Science and Technology are advancing at an increasingly rapid pace and the ways in which they interacts with the economy, society and the environment is becoming increasingly complex. We have a basic act about government performance of science and technology management and many subordinate statutes. It is 'Fundamental Act of Science and Technology', 'Provision on Management of National R&D Permance(enforcement decree)' and 'Enforcement Rule on Management of National R&D Performance'. These act and provisions are to unite the government management of national R&D. However we have had many regal problem, because each competent administrative agency of national R&D have each provision of the management performance about national R&D.The goals of this study are to analyze the problems of the current rules and to propose the improvement of the legislation system to manage the government R&D performance.

    Laws Consideration for Registration of 3D-Cadastral Information

    Abstract
    A land might be artificially specified as an object of public or private activity by demarcating a boundary although it assumes the similitude of continuity. Cadastre which means a registration of physical, artificial situation and a legal right of land for a public announcement is a vital necessity for embodying or using a land.This study aims to examine reorganization of the existing Cadastral Act for registration of three dimensional cadastral information. As a study result, we proposed that the Act should provide a three dimensional lot number and the classification of land category. And also it must be the rule that all building and structure should be registrated. There is no provision in the statute on this point. In the field of cadastral surveying, the method of level surveying should be introduced for gain of three dimensional cadastral information.

    A Legal Review of the Limits on Applicants for a National Technique Qualifying Examination

    Abstract
    Recently, government drew up a plan that places limits on applicants sitting the National Technique Qualification Examination. It did so by amending a related statute. The new criteria will take effect on 1st January 2007. According to the statute, someone who wants to apply for a specific qualification has to graduate from a university and to have produced a related study as part of their major. In addition to this work, and regardless of it, they must also receive training in practical business over a set period of time.The purpose of this legislation is to comprehensively improve expert knowledge and the level of technical education. But it may have negative side-affects, giving rise to serious legal wrangles, over such issues as unfair discrimination and disputes as to how to classify the related major.Therefore, this study will examine the contents of the amended National Technique Qualification Act and investigate some of the legal issues surrounding it. It will also offer suggestions as to how the planned changes could be improved.
