Ein schwierige Problem der Wiedervereinigung der Südkorea und Nordkorea ist die Vermögensfrage. Das Eigentums- und Nutzungsverhältnis an Grund und Boden brauche eine Neuordnung nach der koreanische Wiedervereinigung. Es gab die entschädigungslose Enteignungen auf das Besatzungsgebiet des Nordkoreas. Deswegen braucht das zukunftigen Gesamtkorea eine Lösung, um zu wiedergutmachen Unrecht durch die entschädigungslose Enteignungen in dem Besatzungsgebiet. Einerseits resultiert aus Art. 23 koreanischer Verfassung zunächst ein Verfassungsauftrag zur Eigentumsgarantie für das eigentliche Eigentümer, aber andereseits muß der Verfassungsgeber und Gesetzgeber des zukunftigen Gesamtkorea an das Nutzungsrecht des Nordkoreaner denken.

The Fifth Amendment to the U.S. Constitution provides that private property shall not be taken for public use, without just compensation. This clause places two limitations on the government when it takes private property. The government has to take private property only for public use and pay just compensation for the private owner. The Fifth Amendment allows private property to be taken by eminent domain only for public use. The U.S. Supreme Court cases survey informs us that the term ‘public use’ has been broadly interpreted by the Court. Takings scholarship has focused primarily on the liability question, that is, what government actions are counted as takings of private property. Until now, considerable uncertainties have prevailed regarding the appropriate criteria to distinguish between compensable and noncompensable impositions of property losses by the government. In solving this issue, it is a prior condition that it has to be considered what criteria might best serve to draw the taking-regulation distinction. This article examines the theories on taking of private property, especially focusing on types and conditions of taking in the U.S. Supreme Court cases. That's why most theories on the taking of private property have been embodied through interpretation of the cases by the U.S. Supreme Court, even though they seem to be often unclear and inconsistent. Chapter Ⅰ introduces the meaning of researching the legal issues in takings problem. Chapter Ⅱ brings in and explores key matters of the taking clause in the U.S. Constitution. Chapter Ⅲ examines an analysis of takings' essentials, such as eminent domain, the taking-regulation distinction, the variation in the U.S. Supreme Court's approaches about it and the evolution of the concept of what constitutes public use. Chapter Ⅳ generally deals with a comparative study about legal systems of taking in both Korea and the U.S. Finally we can find that there are many legal points which are similar to those of korean taking system and also that there are the peculiar legal points of U.S. taking system, mainly embodied by the U.S. Supreme Court cases.

Bei der Lösung der Vermögensfragen in Bezug auf die Konfiskationsmaßnahmen in Nordkorea ist zunächst deren Rechtmäßigkeit zu klären. Die sowjetische Besatzungsherrschaft in Nordkorea stellte in der Realität die conditio sine qua non der Gesamtheit der Eigentumsentziehungen im besetzten Nordkorea dar. Demnach muß dieses Konfiskationsgeschehen allein der Kategorie der Besatzungsmacht zugewiesen werden, wobei es sich um die Bewertung anhand der völkerrechtlichen Grundlagen und der Begrenzungen der Besatzungsgewalt handelt. Im Hinblick auf die Kriegsziele der Alliierten, worunter die Wiederherstellung der Unabhängigkeit Koreas fiel, sind sowohl die amerikanische, als auch die sowjetische Besetzung als friedliche Besatzungsart außerhalb des Kriegsrechts (occupatio pacifica) anzusehen. Wie der deutsche Fall zeigt, wird die rechtliche Bewertung der in der SBZ/Nordkorea wirksam ergangenen Eigentumsentziehungen unter dem Aspekt der gesamtkoreanischen Rechtsordnung zu bestimmen sein. Hierbei ist der völkerrechtsfreundliche Art.6 RK- Verfassung von Bedeutung, dessen wesentlicher Regelungsinhalt in der Rechtsordnung des vereinigten Koreas weiterhin beibehalten bleiben wird. Danach rangieren die allgemeinen völkerrechtlichen Regeln auf dem gleichen Rang wie innerstaatliches Recht. Daraus folgt, daß den durch die ehemaligen Sowjetunion im besetzten Nordkorea durchgeführten Konfiskationsmaßnahmen die Rechtswirksamkeit zu versagen sein wird, wenn sie gegen die allgemeinen völkerrechtlichen Regeln verstoßen. Die Konfiskationen brachten die schwerwiegendsten und umfangreichsten Umwälzungen der damals bestehenden Eigentumsordnung und zerschlugen überdies die Sozialstruktur und das Leben eines ganzen Volkes. Es handelte sich also um schwere Mißbräuche der Ausübung von Besatzungsgewalt, die als völkerrechtliche Verbrechen sowie als Verletzung internationaler Verpflichtungen erga omnes angesehen werden könnte. Dadurch wurden überdies unverzichtbare, fundamentale Menschenrechte massiv verletzt. Daraus ergibt sich im Einklang mit einem gewichtigen Teil der Literatur, daß die Konfiskationsakte im Rahmen der friedlichen Besetzung (occupatio pacifica) als Verstße gegen das völkerrechtliche jus cogens angesehen werden müssen. Demzufolge wird für die Rechtsordnung des vereinigten Koreas die Nichtanerkennung der Konfiskationsakte in der SBZ/Nordkorea geboten sein. Infolgedessen müßten die im Rahmen der Konfiskationsmaßnahmen in der SBZ/Nordkorea betroffenen Vermögenswerte den Alteigentümern zurückübertragen werden. In Bezug auf die vermögensrechtlichen Regelungen in Nordkorea dient das Prinzip von Schadenausgleich in natura zu der Aufrechterhaltung verfassungsrechtlicher Garantien für Eigentumsrechtspositionen. Dem Anwendungsbereich des Grundprinzips der Restitution werden unter anderem die Konfiskationen in der SBZ/Nordkorea und die diese begleitenden entschädigungslosen Enteignungen, die Vermögensverluste aufgrund unlauterer Machenschaften und die Vermögensentziehungen durch rechtsstaatswidrige Einzelentscheidungen unterfallen. Hinsichtlich des sozialen Ausgleichs ist dem Interesse am Bestand der Eigentumslage zum Zeitpunkt der koreanischen Vereinigung Rechnung zu tragen. Dies wird dann dadurch umzusetzen sein, daß zum einen das Interesse am ungestörten Fortbestehen der Nutzung des Eigentums, das dem Gemeinwohl dient, weitgehend geschützt wird und zum anderen zur Aufrechterhaltung der Rechtspositionen nordkoreanischer Bürger der redliche Eigentumserwerb nicht rückgängig gemacht wird. Zu berücksichtigen sind auch diejenigen, denen nach DVRK-ZGB Nutzungsrechte an Grundstücken und Gebäuden verliehen wurden.

Article 23 of the Constitution which states individuals` ownership rights as a basic right states further on clause 2 that the right should be exercised in accordance with public interest. The same article clause 3 states land expropriation in necessary cases. Article 122 of the Constitution provides that the state can impose restriction and duty if necessary according to the law in order to guarantee the efficient, balanced development and maintenance of land. Land, an object of ownership rights, has been emphasized regarding the public importance of its usage as a limited good. The public importance of land ownership has been emphasized constantly since the 1948 Amendment. However, the inconsistency of government policy resulted in speculation, which acted as a main cause of the soaring prices of real estates, having a profound impact on national economy and the housing life of people. In 1989, the government introduced the public concept of land ownership in order to regulate real estates speculation and to guarantee the efficient, balanced development and maintenance of land. The public concept of land ownership purports to guarantee the public characteristics of land ownership by emphasizing that land should be efficiently used for public welfare and interest and the state can impose adequate restrictions for it. The public concept of land ownership is a constitutionally important factor considering the reality of our country suffering from the deficiency of available lands. However, an adequate perception of the public concept of land ownership is not yet established in our society. Due to the lack of this perception, it is not easy to promote public projects for public interest. Especially, in the case of public development to expand SOC(Social Overhead Capital), the soaring prices of real estates around expected lands to be developed are not easy to reach with the government's budget. The burden of land expropriation eventually goes to the people. Land bank system was introduced in this context. Land bank system aims to realize public interest with a small cost by expropriating lands in advance preparing for the expected public projects. However, despite the institution's efficiency and future-oriented aim, land expropriation without any concrete plan can violate the ownership right of individuals. Restriction of the ownership rights by mere provisional plans can cause unconstitutionality by violating the basic right of individual. Therefore, in the aspect of both national and individual interest, the institution must be based on constitutional legitimacy. Since 2007, a number of local authorities has prepared to introduce the ‘land bank system’ which reserves land for local public development and directly provides it to investors. It has been considered not to upset the projects by excessive financial burdens caused by price ascension of real estates. With the introduction of ‘land bank institution’, the state and the local authority can alleviate financial burden and thus seek efficiency in promoting the development projects to expand SOCs. If real estate speculation is prevalent like in our country, the unexpected soaring price of real estate is determined to be a setback of governmental public projects, which will eventually act against public and individual interest. Therefore, if land bank undertaking is conducted by a special law enacted upon constitutional basis, unconstitutionality does not seem to be the problem.

Bei dieser Abhandlung haldelt es sich um die Moeglichkeit der Landbank in koreanischen Rechts einzufuehrn. Fuer die Bekomme des Besitzrechts von Boden gibt es eigentlich zwei Moeglichkeiten: D.h. die Verkehrsvertrag zwischen dem Bodensinhaber und den Oeffentlichen Hand und die Enteigung. Bei der Enteigung des Gelaendes mit dem Zweck von Landbank ergibt sich die Frage, ob der Landbankvorhaben den Konditionen fuer die Enteignung zufrieden ist, die fuer die enteignung beduerftigen oeffentlichen Vorhaben benoetigen Oeffentlichkeit anzuerkennen. Im Himblik der Engentumsgarantie nach Art. 23 Abs. 3 der koreanischen Verfassung ist es Erforderlich bei der Anerkennung der Oeffentlichkeit von Minster fuer Konstruktion eine konkrete Plan fuer Nutzung der fuer die Enteignung gegenstaendige Gelaende. Aber es fahlt diese konkrete banutzungsplan des Gelaendes bei der Landbank. Deshalb gibt es hektische Dibate bei der Zeitpuny der Enteignung fuer den Landnbank. Nach der Auffasung des Verfassuers ist es nicht moeglich bei der Landbankvorhaben die Erfuellung der Konditionen fuer die Enteigung. Unter diesem Umstaenden hat das Gesetsentwurf fuer den Landbank abgesehen fuer den Fall keinen Enteignungsvorschrift vorgeschrieben, in dem ein Vorhabendurchfueher selbst aufgrund der koreanischen Enteignungsgesetzes die Anerkennung von Oeffentlichkeit eines Projekts bereits bekommen hatte. Bei diesem Fall ist der Land Koopration Korea, der bei dem Gesetsesentwurf der Rechtsstelle als der Landbankvorgeschrieben wird, als Beauftragter des Vorhabendurchfuehrer den Enteigungsaufgabe durchfuehren. Bei deiser Abhandlung wird andere Rechtliche Probleme behandelt.

Recently the introduction of land banking system has attracted interest from policy-makers and academics in Korea. Although the land saving system is a effective means to provide appropriate public facilities and to manage land market, the system doesn't have ever been enacted due to some financial insufficiencies. Then Lee's government is going ahead enactment of land banking system in order to provide the land for industrial complex and SOC. In this context this paper is aimed at suggesting the policy implications through comparing advanced cases of foreign countries where have introduced and applied the land saving system formerly. The major policy implications are summarized as follows: Firstly, it is necessary to make up the land purchase system. Secondly, it is needed to set up a financial support plan for activating the land purchase system. Thirdly, to carry out land banking, a land banking operation system which allows decision-making and execution independently will be required. Fourth, the reform is needed to connect the urban planning system and land banking system. Finally, this study also presents that a new flexible tax system for supporting land owners is essential for effective operation of the land purchase system.

Both Korea Land Corporation(KLC) and Korea National Housing Corporation(KNHC) have performed their missions relatively well since their establishment as government-controlled companies. As the need for government-led land and housing development has become less important and the autonomy of local governments has been strengthened, however, it is expected that their significance will be reduced. Moreover, public confidence in KLC and KNHC has become greatly weakened in the wake of hikes in land prices and the resulting widened gap between the haves and the have-nots. Thus, the large-scale restructuring of both companies in terms of manpower and the scope of businesses will be a necessary choice in order to regain public confidence. The issue of restructuring can be examined in light of the following criteria. The first criterion is the future direction of government land and housing development policy. The second is what the optimal alternative for efficient - welfare-enhancing - implementation of government policy goals should be. Third, restructuring must maximize the job efficiency of both companies in terms of the quality of services to the people. Fourth, it must pursue managerial efficiency in order to produce surplus, given that both companies are supported partly by the tax revenue. Fifth, the shareholders and employees of both companies should be fairly treated in the process of restructuring efforts, and the chosen restructuring plan should be publicly acceptable. The sixth one is how to comp up with a sustainable restructuring plan to prevent repeated failures in the past. Seventh, we should reach a national consensus on the desirable role of both companies. To put it differently, should both companies be like profit-oriented private companies? Or, should they be public companies which barely meet the balance sheet? Or, should they focus exclusively on enhancing public welfare with government financial support, and is it no problem to disregard managerial efficiency? Based on the above-mentioned discussion, the best option is for both KLC and KNHC to perform more specified missions with their own specialties after restructuring which is reasonable and acceptable. The specified missions of KLC include housing land development in Multi-functional Administrative City, the role as a land bank for stabilization in land prices, the role of a clearing house for land markets, and land development in North Korea. KNHC should focus on carrying out popular rental housing projects and accompanying housing land development, installment housing projects for low-income families, and city rejuvenation projects.

Korea Land Corporation and Korea National Housing Corporation are public enterprises. A public enterprise is an enterprise managed directly by the national or local governments or their corporations for social public welfare. A public enterprise also has a characteristic of private enterprise in that it is an enterprise operated under the direct or indirect participation of national governments or others, but means a business managed for social public welfare, i.e., a business to provide goods or services needed for the life of people or residents. Korea Land Corporation aims to “contribute to the healthy development of national economy by accelerating the efficient use of land resources and promoting the synthetic use and development of national land through the acquisition, management, development and supply of land(Korea Land Corporation act, article 1).” Korea National Hosing Corporation aims to “contribute to the stabilization of people's life and enhancement of public welfare through the construction, supply and management of housing and improvement of inferior housing(Korea National Housing Corporation act, article 1).” Compared with Smend's consolidation process theory, the consolidation of public enterprises should be promoted in an ultimately personal, functional and material consolidation's point of view in order to realize its completion. There should be a legal review in the end in such consolidation. This is just the request from a principle of the rule of law and constitutional state

Along with the industrialization in Korea, it is much more necessary to make industrial complex. Industrial complex make it easy to support the industries there in many way , and make it possible to expect much higher industrial efficiency. So it was the national plan to promote the industry by supporting the industrial complex. But some problems in entering into the industrial complex made the separate industrial district much prevail. Separate industrial district increased near around the big cities. But it is not desirable only to force the industries in separate industrial district to move into the industrial complex. Although there occurred many conflicts and are many problems in the separate industrial district, there also can be found many advantages. So to take advantage of merits and to promote the industrial efficiency thereof, remodelling-plan to improve the separate industrial district is demanded. And the idea of quasi-industrial complex was launched. In some points it looks supplementary to industrial complex. But the importance of that is very great. This article shows the legal status of quasi-industrial complex, and points out some legal issues in it.

Es ist gesagt, daß die Entwicklung im Industriegebiet der öffentlichen Hand gehört. Aber die Entwicklung durch die öffentliche Hand bringt einige Nebeneffekte z.B. so wie Unwirtschaftlichkeit, Effektivitätslosigkeit usw. Darum diskutieren die öffentlich-rechtlichen Wissenschaftler die Notwendigkeit der privaten Initiative in der Gebietsentwicklung, um diese Probleme zu bewältigen. Insbesondere hat die koreanische Regierung das neue Gebietsentwicklungssystem wie das Quasi-Indurstriegebiet eingeführt. Dieses Entwicklungssystem hat einen Zweck, nämlich das unordentlich angesiedelte Industriegebiet in der Gegend der Hauptstadt neu und systemgerecht zu entwickeln. Wegen der Einschränkung der Entwicklung in diesem Gebiet durch das sehr komplizierte Planungsrecht hatten die Unternehmer große Schwierigkeiten, ihre Fabrike umzuordnen. Darum bereitete das koreanische Parlament den Unternehmern die Erweiterungsmöglichkeit bzw. die Umordnungsmöglichkeit durch die Einfügung des Quasi-Industriegebiets in das Gesetz für Indurstrie Ansiedlung und Entwicklung. Beim Quasi-Industriegebiet läßt sich die private Initiative bei der Gebietsentwicklung durch die Beantragung des Entwicklungsplans und auch durch die Enteignung des benötigten Bodens hervorheben. Darum entstehen die Konflikte einerseits zwischen dem öffentlichen Interesse und der privaten Initiative, andererseits zwischen der Gegend der Hauptstadt und der Gegend der Nicht-Hauptstadt. Die Festsetzung des Quasi-Industriegebietes bringt mit sich auch die ersetzenden Effekte anderer Planungen so wie die Gebietsentwicklungspläne und auch die Bebauungspläne. Bei disesem Aufsatz sind insbesondere die rechtlichen Probleme der privaten Initiative bei der Entwicklung durch das Quasi-Industriegebiet behandelt. Wegen der privaten Initiative sind die öffentlichen Interesse mit großem Schwerpunkt Rechnung zu tragen. Dafür gibt es die Teilnahmerechte der Bürger, die Aufsichtsrechte der Verwaltung und auch die Verteilung des erworbenen Entwicklungsinteresses seitens der öffentlichen Hand. Bei der Entwicklung durch das Quasi-Industriegebiet ist das rechts Problem der Subjekt der Enteignung zu erheben, ob die Privaten das Subjekt der Enteignung werden kann und auch ob ein Privatinteresse als Zweck der Enteignung werden kann. Heutzutage können die obengenannten Fragen mit Ja geantwortet werden. Darum wird die genügende Harmonisierung unter den betroffenen Interessen bei der Entwicklung durch das Quasi-Industriegebiet noch wichtiger.

House redevelopment projects are conducted to improve residential environment of areas with poor infrastructures and many superannuated buildings in compliance with the Urban and Residential Environment Maintenance Law. Therefore, in case of ignoring the situation, a city will lose its functions because areas become slums. Accordingly, although harmonious and prompt maintenance work is required, many cases in which delay of process and economic loss are inevitable because of differences between actual conditions in the maintenance site and disposal policies of the authorities were found. First of all, Article 46, Clause 1 of the Urban and Residential Environment Maintenance Law is contradictory to reality because it claims that approximate allotments, application period for sale, and other matters decided by a Presidential decree should be notified to land owners within 21 days from a notification of a project approval. Secondly, some items of the articles of association have problems because there have been many cases in which association members gave up contracts claiming that they don't like the building and the house number decided by computer lot according to Article 42, Clause 5 when the computer lot for association members is conducted and contracts are concluded at a time of completion of removals and demolition after approval of the management and disposal plan. Thirdly, disposal of state and public lands does not accord with reality, becoming another obstacle to redevelopment projects. Therefore, the necessity of improvement measures of laws and systems at the management and disposal stage for activation of house redevelopment projects in Busan area was proposed. The current study suggested solutions such as partial revision of the Urban and Residential Environment Maintenance Law and revision of the articles of association.

The necessity of housing redevelopment is gradually increasing since to build up new towns with low growth of population seems inefficient requiring a lot of social costs in many aspects. This study analyzed problems by researching into the system and condition of Busan metropolitan city and suggested plans for the efficient housing redevelopment. The followings are the improvement measures that were elicited from the results. The cardinal direction of improvement measures of an house redevelopment project is not just to improve poor and deteriorated houses but to approach the project as a social policy which has the aspect of recovery of the city to an ideal state and stabilize housing and life problems of low-income population. The followings are the improvement measures against the factors which delay the project. ① It is simple procedures of the project that we need. To improve the project formalities, the local government will have to be given responsibility and duty for house redevelopment projects to minimize unnecessary intervention from the central government. ② The local government must help to activate inhabitants' meetings for their participation in the project and receive the advice from non-government organizations. In case of Busan, the redevelopment is increasingly important. The problems concerned are emerging in line with the functional and structural changes of the city. Therefore, the solutions shouldn't be approached without considering social, historical, and economic structure of the city. Furthermore, the rearrangement should be recognized as long-term projects which can be continuously improved to adapt to ever-changing circumstances in accordance with the development of Busan city.

Die vorliegende Arbeit befaßt sich mit der Klagebefugnis der Dritte, die gegen eine erteilte Baugenehmigung eine Anfechtungsklage erheben will. Der japanische oberste Gerichtshof hat in seinem Odakyu-Urteil vom 7. Dezember 2005 die Anfechtungsklagebefugnis der Dritte gemäß § 9 Abs. 2 des japanischen Verwaltungsprozessgesetzes (JVwPOs) entschieden. Nach dem § 9 Abs. 2 JVwPO in neuer Fassung vom 9. Juni 2004 sind bei der Prüfung der Klagebefugnis der Inhalt und die Beschaffenheit des zu eingreifenden Interesses in der rechtswidrigen Verfügung sowie dessen Art und Umfang zu berücksichtigen. Die Klagebefugnis der Dritte könnte dadurch beträchtlich erweitert werden. Es ist allerdings nicht zu verkennen, dass oberster Richter Hujida die Risikoschutzpflicht des Staates in seiner ergänzenden Auffassung anerkannte. Diese Theorie bezieht sich auf die Interpretation des Interesses. Die vorliegende Arbeit analysiert dieses Odakyu-Urteil mit verschiedenen Aspekten. Der Verfasser freut sich, dass unsere Klagebefunistheorie durch diese rechtsvergleichende Untersuchung zwischen koreanischer Rechtsprechung und japanischer weiter verbessert wird.

In November of 1997, Korea faced the IMF economic crisis. This made some of middle class people bankrupt and homeless people. The number of homeless people reached about 5,500 in 2007. The government open shelters for homeless people, but the programs of rehabilitation, management and housing program were not fit for them. Because these are not concern with housing and social exclusion. First and foremost, homeless is the problem of poverty and resident poverty above all. So the government have to supply many public houses for them with welfare services. Social exclusion is a relatively new term in Korean housing policy-not only referring to poverty and low income but some of their wider causes and consequences. Of course, there are the many of act for public housing construction in Korea. And the purpose of these act are : for devising the security of living the homeless and improvement national residing level and the primary goal of hosing policy is to homeless nation. However in spite of setting up legal system, there is not a few the positive results that the actual benefit of policy come not for the low-income group. In conclusion, for justifying housing legal system, it have to revise to guarantee the social weak. The purpose of this paper is to punctuate the needs for enactment of homeless act and reform of housing law.

This research aims to study the legal issue of farmland law of Korea that is dealing with farmland acquisition performed by private enterprise. In large-scale estate development, private enterprise should purchase a vast extent of land to continue their own development. And in many cases, farmland is included in their target land. But in current Korean farmland law, strict restriction is provided to purchase farmland when a purchaser is not a farmer or prospective farmer. This kind of restriction is called “Land to the tillers Principle” and this principle is expressly stipulated in Korean Constitutional Law. And this priciple is based on the serious reflection about past abuses of the tenant-farming system. But on the other hand, the idea of following this principle blindly can also raise concerns about increase of public expenses, contraction in land-development business, etc,. For example, private enterprises that want to develop large-scale estate are compelled to purchase farmland at the highest cost in comparison to normal estates because they should acquire the ownership of farmland after they finish the legal formalities when speculative forces are already intervened. In mentioned case, there may be no difference between farmland and normal land in the position of developers and we can call this kind of unfairness, “the side effects of strict restriction.” So this paper examines legal problems caused by current Korean farm land law and other laws related to land development. And in the conclusion I suggest a point of contact to coordinate legal construction or legislative reviews between our constitutional principle and also economical efficiency or legal unity.

Nach dem Zweck der Besteuerungen lassen sich die Fiskalzwecksteuer und die Lenkungsteuer unterscheiden. Bei dem Prinzip, das bei der Steuererhebung einzuhalten ist, sind auch dementsprechend anders, d. h. einerseits fuer den Fiskalzwecksteueren das der Gleichheit, andererseits fuer den Lenkungssteueren dennoch das der Effektivität und gleichzeitig das der Verhältnismässigkeit. Im übrigen kann man im rechtsvergleichen Überpruefung über die Pauschale Steuer auf eine oder mehrere unbeweglichen Sachen mit denen von Japan feststellen, dass die koreanische nicht genügend die dafür erforderlichen Anforderungen erfüllt hat, die anzuwenden Bereich eng zu begrenzen und nach dem Verhältnissmässigkeitsprinzip den einen mindest beeinträchtigenden Mittel zu greifen. Keinen Zweck von den beiden, gleichzig gestellten Zweck d. h. einerseits den Fiskalzweck fuer den Kommunen und andererseits den spekulativen Investitutionen auf unbeweglichen Sachen zu bedämpfenden Lenkungszweck koennten noch erreicht werden. Es ist also wünschenswert, diese Art von Steuer zu verbessern.

This article aims a scientific analysis about the relationship between the Public- Private-Partnership and the Public Contract Regulations in the United Kingdom. First, the meaning, the legal foundation and the model of Public-Private- Partnership (PPP) in Great Britain were put in order. Second, the structure and main contents of the Public Contract Regulations(PCR) were adjusted. The relationship between the PPP and the PCR in the United Kingdom was analysed on this basis. Followings are the results of this analysis. The PPP is widely used in the United Kingdom, but there is no special regulation only for the PPP. The PCR specify the procedures to be followed in relation to the award of public works contract, public supply contracts and public services contract. The contracting authorities are listed in regulation 3 of the PCR. The contracting authorities for the PPP contracts have to be one of the authorities in regulation 3 of the PCR. The PCR apply whenever a contracting authority seeks offers in relation to proposed public works contract, public supply contracts, public services contract, framwork agreement or dynamic purchasing system according to the regulation 5 of the PCR. But the PPP contracts are such a complex situation as to choose one of the contract type regulated in the PCR. For the purpose of seeking offers in relation to a proposed public contracts, a contracting authority shall use the open procedure or the restricted procedure in all circumstances, except where it may use the negotiated procedure or the competitive dialogue procedure. This principle of contracting procedures have to be applied in PPP contracts. A checklist about how to select a contract award procedure in PPP contracts was formed in this article.

Das Verwaltungskonzept ist einerseits so ordnungspolitisch, dass es die Handlungsform der Mehrheit anweist, andererseits fasst auch die Konkretheit um, weil es eine Verordnung über die konkreten tatsächlichen Situationen ist. Unter diesem Gesichtspunkt kann es schwer sein, die gesetzliche Form des Verwaltungskonzepts als Norm, Verwaltungsakt oder als besondere gesetzliche Form kollektiv anzusehen. Die Handlungsform des Verwaltungskonzeptes soll selbstverständlicherweise auch mit einer geeigneten gesetzlichen Form bekleidet sein, denn die auf die Vorschriften der Verfassung und des Verwaltungsprozessrechts basierte Abhilfsmaßnahme für Volksberechtigung ist in der herkömmlichen Handlungsform, d.h. in der sogenannten “Maßregelung” begründet. Es ist daher nicht überzeugend, das ein Verwaltungskonzept einmal als eine Verwaltungsaktsform unter dem Gesichtspunkt vom Rechtsschutz zu behandeln, aber dasselbe unter dem Gesichtspunkt dessen Änderungsmöglichkeit als eine Verordnungs- form zu erwähnen. Koreanische gesetzliche Form des Verwaltungskonzepts unter der Anwendung der förmlichen Verfassung, Verordnung, Vorschrift, Verwaltungshandlung, satzung, oder Regelung als unterschiedliche Typen des Verwaltungskonzepts anzunehmen, könnte nun widersprechend sein. Wenn aber in Vergleich mit der angemessenen Funktion der Diskussion von Deutschland der Festlegungsprozess des Verwaltungs- konzepts in der wörtlichen, wesentlichen Rechtsabhilfsebene systematisiert und das System für Verwaltungsurteil bzw. Verwaltungsrechtspflege verbessert werden kann, ist es sehr anregend für den Rechtsschutz, die Handlgungsform des Verwaltungskonzepts mannigfaltig zu machen, und durch Überlegung der darausfolgenden gesetzlichen Beschaffenheit die Abhilfsmaßnahmen der Volksberechtigung zu verstärken. Die Diskussion über die gesetzliche Beschaffenheit und die gesetzliche Form des Verwaltungskonzepts ist daher notwendig, um den tatsächlichen Schutz vor der durch die Förderung des Verwaltungskonzepts verursachten Verletzung des Vermögensrechts zu realisieren.

Therefore, If anyone among person concerned of contract violates Establishment's regulation which is the condition of contract, become action that violate. The Supreme Court is judging that National dean reprimanding disobey to school regulations violates, it is establishment violation of a establishment's regulation justly. Conclusively, when we classify establishment‘s regulation by office regulation and utilization regulation, office regulation is administrative regulation and utilization regulation has double nature. first, It is administration rule interiorly, second, It is the condition of contract externally.

Die Polizeiverantwortlichkeit kann als drei Teile verteilt werden. Erstens handelt es sich um die Verhaltensverantwortlichkeit, wonach eine Person die polizeiliche Gefahr bzw. Verhinderniss versursacht und auf dieser Person polizeiliches Recht ausgeübt wird. Zweitens, handelt es sich um Zustandverantwortlichkeit, wonach nicht wegen eines Verhaltens einer Person, sondern wegen eienes Objekts die polizeiliche Gefahr bzw. Verhinderniss entstanden ist und die Person, die mit dem Zustand eines Objekts zu tun hat, eine Verantwortung übernimmt. Drittens, geht es um mehrheitliche Polizeiverantwortlichkeit, wonach diese Verantwortlichkeit vom Verhalten mehrere Personen oder des Zustandes eines Objkets, das von mehreren Personen, die damit zu tun haben, verwaltet wird, verursacht wird oder von der Verbindung der Verhaltensverantwortlichkeit und Zustandsverantwortlichkeit die polizeiliche Ordnung verstoßt wird. Außerdem befindet es sich als Ausnahme der Polizeiverantwortlichkeit polizeilicher Notstand, wonach derjenige, der das Entstehen der polizeilichen Gefahr buw. Des Verhindernisses nicht zu tun hat (nicht-Polizeiverantwortlichkeit), zur polizeilichen Rechtsausübung gezogen wird. Da bis zurzeitlichem Moment die polizeirechtliche Ausübung, die mit der Polizeiverantwortlichekeit zu tun hat, in Korea als Grenze des logischen Denkens erkärt wird, geht man davon aus, dass das Problem der polizeirechtliche Ausübung mit dem Mittel der Erklärung auf dem logischen Denkens gelöst werden kann-obwohl Polizeiverantwortlichkeit im positiven Recht nicht bestimmt wird. Da aber die Tatsache, dass die Lösungsmethode, wonach zur Polizeiverantwortlichkeit gezogen zu werden als mit dem Mittel der Grenze auf dem logischen Denekn gelöst wird, gegen das Prinzip der Gesetzvorbehalt könnte sein-“könnte durch das Mittel der logischen Denken die Freiheit und das Recht der Staatsbürger verletzt werden?”-ist es logische, dass diese Problem legislative gelöst wird. Da das derzeitige Polizeivollstreckungsgesetz über Polizeiverantwortlichkeit nicht klar bestimmt und nach eigenem Ermessen der Polizei das polizeiliche Recht ausgeübt wird, könnte Polizei sein Recht mißbruachen. Mangel am Regel der Entschädigung vom Verlust auf der polizeitliche Ausübung gegen die nicht-verantwortliche Person ist ein großes Problem.

Zur Zeit liegt Repubilk Korea wegen der amerikanischen Finanzierungsschwierigkeit wieder in der Währungs- und Wirtschaftsgefahr des Kapitalmarkts. Aus diesem Grund ist es neben der Währungsproblemen noch wichtiger geworden, ob koreanische heutige Regierung die zunehmende Staatsverschuldung besser verwalten kann. Aber heutige koreanische Regierung hat ganz falsches Verständnis auf der Krediaufnahme. Im Allgemgeinen geht es bei der Kreditaufnahme des Staates um die Beschaffung der Geldmitteln von der öffentlichen Hand, die von den nächsten Generationen verzintzt und durch das Steuer zurückgegeben werden sollen. Allerdings bezeihen sich diese Bedeutung des Staates im Sinne des Staatsv- erschudlungsrechts nicht nur den Staat in dem engen Sinne, sondern auf dem Gesamtstaat in dem weiteren Sinne und betreffen damit namentlich auch die Kom- munen und Sozialversicherungsträger. Aber unser Reigerung wollte sich daraus keine konkrete Neuveschuldungsgrenze für den Staat ableiten lassen. Aus diesem Grund wird in vorliegender Arbeit die Bedeutung und wesendliche Inhalte der Staatsverschudlung im Vergleich mit dem europäischen und deutschem Recht untersucht. Schließlich soll koreanische Regierung den Bereich der Staatsveschudlung auf die Kommunalverschuldung und die Verschuldung der Sozialversicherung und erweitern und damit soll sie auf die Wirtschaftskirese besorgen und absichern, weil nach diesem Verständnis koreanische Staatsveschludung verdoppelt wird.

Es handelt sich bei dieser Untersuchung darum, wie Raucher und Nichtraucher verfassungsrechtlich geschützt werden. Rauchen als Rechtsproblem beschäftigt dabei vor allem die Nichtraucher, die unfreiwillig zu Passivrauchen werden und sich das angesichts der gesundheitlichen Konsequenzen nicht gefallen lassen wollen. Rauchen führt deshalb zu heftigen Auseinandersetzungen zwischen Rauchern und Nichtrauchern. Kritisch wird es dort, wo Menschen auf relatvie engem Raum miteinander zu tun haben und für beide Seiten nur beschränkte Ausweichmöglichkeit bestehen. Raucher und Nichtraucher sind als Grundrechtsträger im Verfassungsrecht zu schützen. Der besondern Bedeutung der Grundrechte von Rauchern und Nichtrauchern für die verfassungsmäßige Ordnung des koreansichen Verfassungsrechts entspricht das Bestreben, den Bestand und die Wirksamkeit der Grundrechte zu schützen und zu erhalten. Der Aufgabe dieses Schutzes dienen die dem koreanische Verfassungsrecht unbekannten Regelungen des Art. 10, namentlich die Gewährleistung des Schutzes durch die Gerichte und das Institut der Verfassungsbeschwerde. Ruacher und Nichtraucher sind durch die Theorie von Schutzpflicht des Staates zu schützen. Demgemäß kann sich unmittelbar aus das Recht auf Rauchen und Nichtrauchen eine staatliche Pflicht ergeben, ein durch diese geschütztes Rechtsgut vor rechtswidrigen Eingriffen anderer zu bewahren.

The government has implemented a levy on tobacco consumption (hereafter tobacco levy) and is currently considering increasing the tax rate 61% to 70% of tobacco price. This has raised a lot of arguments since this tobacco levy is different from other typical levies. We conducted this study to investigate whether the legal bases used to support the collecting of this tobacco levy is constitution or not. This study covers the legal characteristics of tobacco levy. the current system, which gives the rationals for the tobacco levy(the national health promotion fund), and a critical review on the legal aspect of the tobacco levy and its current use. A typical levy can be legally supported by 3 criteria; Are individuals who pay tobacco levy (hereafter levy-payer) homogenous enough to be treated as a group?; Levy-payers have more responsibility than the general public with regards direct as well as sufficient benefits from the levy? The main findings of this study are as follows: Firstly, it is unreasonable that actual levy-payers who pay the tobacco levy are end consumers who buy cigarettes. it is because the tobacco business or industry has a legal obligation to pay this levy but they just transfer it to the end consumer so that they do not pay the levy at sll. End consumers cannot be treated as a homogenous group . Secondly, it is unreasonable that tobacco consumers(levy-payers) have more responsibility to promote public health and/or are more responsibility for public health. Thirdly, it is unreasonable that end consumers as well as tobacco businesses not get sufficient benefits from the levy. The fund is mainly used for other general public uses. Moreover, current health insurance law prohibit reimbursement for smoking cessation. It is contradictory to the national health promotion law, which prescribes that the levy must be used for smoking related disease. There is no strong legal support for the tobacco levy. The current system on tobacco taxation would require a legal amendment.

The Constitution Article 9 provides; “the State shall strive to sustain and develop the cultural heritage and to enhance national culture.” That means the protection of cultural properties is manifestly a constitutional matter for the state to have an obligation to take care of in Korea. No doubt, the protection of cultural properties is necessary for sustenance of the Korean national cultural identity. And also the Cultural Properties Protection Law is adopted precisely to fulfill that important Constitutional obligation of the state for the protection of cultural properties and world heritage. Therefore Cultural Properties Administration is established to implement the Cultural Properties Law and related policies. Generally after going through the Cultural Properties Protection Committee, the Cultural Property Preservation Bureau designates intangible cultural assets, human cultural assets etc. as important cultural properties according to the Cultural Properties Protection Law. However, the Cultural Properties Protection Law has some problems. First, the Law is not a good to protect cultural properties and contains some shortages or an insufficiently enacted provision. Second, the Law itself is not sufficiently or aggressively implemented unhindered by bureaucratic read tapes and mannerism. All people think that the state does not complete its constitutionally provided obligations of the protection for cultural properties with the Law alone. In the long run, the protection of cultural properties is dependent on a willingness of the citizens including the officials in charge, and we have to accept the legal theory of the Enjoyment Right of Cultural Properties, which is the heart of the matters in the policy-makings and laws for protection of cultural properties.

The object of Teachers' Ability and Development Evaluation System was what enhanced trust in Public education and contributed to improve quality of School education. But as government officials ran into a flak from several teachers' organizations, they said they would decide personnel changes and pay according to present Teachers' evaluation system, and would use evaluation result of Teachers' Ability and Development Evaluation System only for teachers' professional development. This system was to be put in force in 2008, but it was forced to be delayed by legislation laches. Therefore, this paper will examine essential contents of this system and teachers' specialty in order to set this system in good condition, and also will consider enlargement of evaluation sphere, harmony of universality and individuation, and improvement in feedback system about test result as main problem to enhance teachers' technical knowledge. Lastly, I will examine betterment in working conditions, reform of laws and regulations in systematic and financial aspects, and connection of teachers' training and compensation.

The financial authority of local governments forms a part of local autonomy which is indispensable for the self-administration and the legal integrity of local governments, and that's the very reason why the financial authority is an important issue in the relationship with their central government. Discords and controversies between the a central government and local ones after the decentralization have been caused by dissenting opinions between them. Financial conflicts today are being created mainly in the issues such as the security of tax sources, the allotment of expenses and the financial disparity between self-governing bodies. But the realities in Korea, when it comes to these issues, leave much to be desired: Korea is poor in legal measures to settle financial troubles between the central government and the local ones. Although the Korean decentralization has not reached the stage in which the local governments are authorized as exclusive governing bodies, but the local governments, like the central government, are supposed to carry out their administrative responsibility for the welfare of their inhabitants. So the conflicts and discords between the central government and the local ones must be treated as the collision of legitimacy, therefore both confronting parties must be considered as cooperative and interactive partners in a regulating and settling process of their interests. In case of a financial conflict between the central government and a local one a judicial process based on the Article 61 and 62 of the Constitutional Court Law can solve the problem. This kind of constitutional process to solve the controversies of competence carries an important meaning, when it comes to a legal tool to guaranty the effectiveness of the local autonomy, because, except for it, there are no specific measures for the settlement of financial conflicts. None the less, the Constitutional Court of Korea are not exploiting its judicial potential for the effective settlement of financial conflicts. Another device to settle the conflicts is a mediation through the Local Autonomy Law, but it can not make up the lack of a specific and effective mediation process to settle the financial conflicts between the central government and the local administrations. The only legal institution that can mediate the financial conflicts under the present law is the Committee for Administrative Consultation and Coordination, based on the Clause 8 of the Local Autonomy Law. But because it is not empowered to settle the conflicts, its effectiveness as an active trouble reliever is questionable, especially when we think of the fact that it mediated only eight cases and rejected two since its establishment on 13, May, 2000. According to the Clause 106 of its implementing ordinances the directors in charge in the central government and the head of the local governments have to execute the decisions of the committee, but it lacks a judicial tool for a compulsory performance. To appeal to compulsory measures is inferior by far than to make a compromise, and the institutionalization of the conflict settlement must aim at it. It is also of practical use in terms of cost saving. Therefore, the most pressing matter today is to complement the activity of the above mentioned Committee for Administrative Consultation and Coordination. This treatise aims at the discovery of some leading clues for a complement of the related laws, examining the Japanese mediating system for financial conflicts.

This paper is to the Zone of Protecting the Freedom of Privacy in Article 17 “The privacy of no citizen shall be infringed.” of Constitution of the Republic of Korea. The Reserch method is the analysis of Constitutional Court of Korean's decision on privacy invasion by mandatory seatbelt requirement in 2003. The background of case is the provision 48 of the Road Traffic Act obligates drivers of vehicles to wear seatbelts while driving and the provision 118 of the Road Traffic Act provides for a notification procedure for the payment of administrative fine for violations above provision 48. The complainant was cited by a police officer and notified to pay administrative fine in the amount of 30,000 won while driving without wearing a seatbelt. The complaint thereupon filed a constitutional complaint in this case on the ground that the provision 48 and 118 of the Road Traffic Act infringe upon the general freedom to act, the freedom of privacy, and the freedom of conscience of the complainant. The Constitutional Court, in a unanimous opinion, held that the provisions at issue in this case are not unconstitutional. (1) General freedom to act includes the freedom to conduct all actions and inactions and does not merely protect conduct that has value. Therefore, in the scope of its protection, a right to live in a rather dangerous way is also included, and the right not to wear seatbelts falls within the scope of protection of general freedom to act that sterms from the right to pursue happiness guraranteed in Article 10 of the Constitution. Mandating a seatbelt requirement is to protect the mutual interests of the social community by preventing and removing the danger and the hidrance to the life and bodily safety of citizens that may be caused by traffic accidents, by reducing the social cost incurred by the traffic accident and by maintaining traffic orders. Then, the provisions at issue in this case do not excessively infringe upon the compalinant's general freedom to act in violation of the principle of proportionality. (2) The road utilized for general traffic falls into the realm where the national and local governments are responsible for management threof, and such realm is interrelated to the legal interests of numerous other drivers and pederstrians or the community interests. Thus, the act of driving a vehicle thereon is no longer a conduct that occurs in a personal and intimate arena. Therefore, as the question of wearing a seatbelt behind the wheel while driving is no longer a question belong to the zone of privacy, the provisoin at issue in this case do not infringe upon and the freedom of proiavcy of the complainant. (3) Conscience that is protected by the Constituion is a strong and sincere voice of one's mind without acting according to which one's existential value of personality would collapse and is not a vague and absract concept. Therefore, wearing a seatbelt in order to avoid a sanction while driving does not belong to the area protected by the freedom of conscience This paper concentrates on the provision 48 and 118 of the Road Traffic Act infringe upon the freedom of privacy. As the standard of judgement on the Zone of Protecting the Freedom of Privacy, First, a conduct that occurs in a personal and intimate arena. Second, the basic conditions for privacy concerning overall personality and survival of such individual. Third, to the core area for self-determination or the essence of personality. Therefore, as the question of wearing a seatbelt behind the wheel while driving is no longer a question belonging to the zone of privacy, the above provisions of the Road Traffic Act at issue in this case do not infringe upon and the freedom of privacy of the complainant.

Der Staat der Gegenwart lässt sich auf dem Gebiet der Inneren Sicherheit nicht auf das liberale rechtsstaatliche Modell verkürzen. Er ist vielmehr längst auch zum Präventionsstaat geworden. Im modernen Sicherheitsrecht hat ein Paradigmenwechsel staatgefunden. Zunehmend in den Vordergrund rückt nämlich im Recht der Inneren Sicherheit der Schutz durch den Staat. Der liberale, auf Gefahrenabwehr beschränkte Polizeibegriff hatte durch das Kreuzbergurteil seine nachdrückliche Anerkennung gefunden. Die Bedeutung dieser verwaltungsrechtlichen Weichenstellung ist allerdings nicht auf das Polizeirecht begrenzt, sondern hat eine grundlegende verfassungsrechtliche und staatspolitische Bedeutung erlangt. Präventionsstaats wartet nicht ab, bis ein konkrete Schadeneintritt wahrscheinlich oder Anzeichen für eine geschehene Straftat sichtbar werden, sondern sie will der Realisierung von Risiken aller Art zuvorkommen, sie zielt also auf Aktion, nicht bloße Reaktion, sie fordert operatives, proaktives Polizeihandeln. Die Konturen solcher Aktionen werden aber nicht durch raum-zeitlich bestimmtbare Schadenswahrscheinlichkeiten bestimmt, vielmehr bleiben sie unbestimmt, so unbestimmt und unberechenbar wie dei Risiken, deren Verwirklichung sie verhüten sollen. Unter der Geltung des bekannten polizeirechtlichen Satzes “Je größer und folgenschwerer der möglicherweise eintretende Schaden ist, umso geringer sind die Anforderungen, die an die Wahrscheinlichkeit seines Eintritts gestellt werden können”, gehen im Falle von Terror ähnlich wie beim Umweltrecht die Anforderungen an die Plausibilität der Wahrscheinlichkeit von Schaden gegen Null. Das sprengt das Polizeirecht und daran entzünden sich die bekannten Polemiken Freiheit versus Sicherheit und umgekehrt. In der Sache geht es darum, im Meer der Ungewissheit eine Norm zu findne, an der man sich festhalten und für sich entscheiden kann, ob ihre Geltung das Sterben lohnt.
