ABSTRACT

A Discussion of the ConceptuaThis study examined the need to establish a unique concept of software forensics and its measures. Currently, the term "digital forensics" is used as a comprehensive concept in South Korea, but this conceptual structure reveals its limitations in resolving software-related disputes. This is because digital forensics focuses on the technical and procedural aspects of evidence collection and preservation, while software forensics requires analysis and evaluation based on software engineering expertise and judgment based on legal knowledge. Therefore, it is necessary to clarify the expertise and responsibilities of each stage of the litigation process, ensure the efficiency of legal dispute resolution, and effectively respond to the increasing complexity of software-related disputes. To do this, it is necessary to develop software forensics as an independent field, separate from digital forensics. To this end, we suggest that efforts are needed in the areas of governance, market formation, professional development, and active support for forensic model research in the field of software forensics.l Distinction between Digital Forensics and Software Forensics
