AB - We are now standing at a turning point, where the new technological paradigm and the industrial convergence are developed in succession. These mega trendy phenomena result in the creative outputs surpassing the domain, the genre, and the boundary. In this contemporary context, it becomes crucial to have systems and order that promote activities of creativity and convergence. We should recheck regulations, especially, those which will no longer be available in the era of the creative economy while possible when the single technology and industry are dominant. That is the problem concerning barrier to entry in regards to the concept that various industrial activities differ from one another.
In this paper, I suggest effective strategies for regulatory reform to promote creativity and convergence, by suggesting four directions of regulatory reform in concert with the new paradigm of the technological and industrial convergence, as follow:First, entry regulation should be overhauled and rearranged entirely. To cultivate vibrant fusion and integration across all sectors, a favorable environment in which creativity, autonomy, and diversity can be achieved is required. Also, on the basis of this principle, regulation of entry barrier should be comprehensively reviewed.
Second, it is recommended that the regulations governed by positive system drastically be converted to negative system.
Third, it is critical to not only promote the competition in the existing market, but also build up an environment favorable to market contestability, which increases the likelihood of potential market entry.
Fourth, besides official regulation through laws and systems, as in the case of order specifications, changing informal practices implementing on the actual market also poses major challenges.
