ABSTRACT

The purpose of this article is to analyze the current condition and underlying problems of administrative guidance in local administration, through the in-depth interview research targeting street-level bureaucrats, and to present the measures to improve administrative guidance. To the end, the article first carried out theoretical debates on the concepts, characteristics, and types of administrative guidance, and then reviewed major precedent studies on administrative guidance in the subjects of administrative law and public administration. The following chapter examined the current condition and underlying problems of administrative guidance in street-level local administration through the investigation into street-level bureaucrats' recognition and evaluation on administrative guidance. Attention was paid to analyzing the motivation, methods, utility, and negative effects of administrative guidance. The comparison between administrative guidance and administrative regulation was also conducted. Finally, the article suggested the measures to renovate administrative guidance in street-level local administration in the following manners: harmonizing administrative guidance with administrative regulation, preventing the abuse and misuse of administrative guidance, strengthening the responsibility and accountability of street-level bureaucrats, providing street-level bureaucrats with educational opportunity for administrative guidance, making provisions for subsequent remedial measures, developing systematic standard manuals, and disseminating outstanding cases of administrative guidance.
