ABSTRACT

The purposes of this study are to consider disabled children's educational discrimination in the law of prevent discriminating the disabled and suggest the future's tasks. The law which prevents discriminating the disabled has been fulfilled for 3 years, but if examining forms of petitions discriminating the disabled in the section of 2010's Education Ministry of National Human Rights Commission of Korea, it showed the part of convenience provision for classes·tests evaluation (12 matters, 21.8%), approach and using of facilities and others (11 matters, 20%) in order. The problems can be suggested as followed, focusing on prevention of educational discrimination and duty of providing proper convenience in Article 13 and 14 of the law which prevents discriminating the disabled. The first, the regulation for concrete fulfillment of proper convenience for roles of people in charge of education, their limitation of responsibilities, etc. must be suggested. The second, educational institution suggested in law must recognize that the standard establishing support system is a militation that school can fulfill by themselves for physical convenience support, teaching-studying support, supporter arrangement, employment and career support, etc. And, they also must secure support and finance of nation.
