A Study on Compilation and Utilization of Litigation Guidelines Called Sasongyuchi for Local Magistrates During the Joseon Dynasty Period

ABSTRACT

This study aims to examine the background of publication and the system of Sasongyuchi (詞訟類聚), which was most widely known and continuously distributed and reproduced during the Joseon Dynasty period and to look into changes in publication status and the version of Sasongyuchi before and after the Imjin War. I have also examined how local magistrates nationwide used Sasongyuchi reproduced in this manner based on records in old literatures. Sasongyuchi was published again as a book printed using wooden movable type called Gyeolsongnyuchi in Jeonju before the Imjin War following its initial publication by Kim Tae-jeong as a xylographic book in Jeonju in 1585. Several woodblock-printed books attached with supplementary manuscript apart from Sasongyuchi in Jeonju were published after the Imjin War although its place of publication is not known. Yeongcheon Sasongyuchi, which was a script version of the wooden type book Gyeolsongnyuchi was also published. The periods of publishing these woodblock-printed books have been estimated based on the reference of the ownership stamp in the body, ‘Daemyeongnyeongi’, ‘Bonchonyeongi’, Gangi etc. since they were not mentioned in historical sources. Along with these, it has been identified that Sasongyuchi was quoted in national law books and law book collections created by the king’s command, which confirms that it was an offical litigation guidelines used in practical purposes and that local magistrates nationwide read Sasongyuchi during their term in office and used it as a reference material for actual litigation cases based on the preface of Park Tae-bo, Jeong Yak-yong’s appointment as a local magistrates and offical records of government authorities. The brief introduction of Sasongyuchi has been presented from its initial publication in 1585, followed by its revised and complementary versions of Gyeolsongnyuchi and Gyeolsongnyuchibo. When it comes to Sasongyuchi, however, it is not easy to estimate the change of its publication based only on the change in its title and presumably there were many occasions of its publications along with the presence of its multiple copies. Therefore, further researches into books or manuscripts that influenced the initial publication of Sasongyuchi and its revised and reproduced versions will be required in the future.
