A Comparative Study on the Legal Frameworks for Digital Legal Deposit of Government Online Publications in Korea and Other Countries

ABSTRACT

This study aims to analyze the institutional limitations of the deposit system for government online publications and to derive directions for legislative improvements to ensure the stable collection, preservation, and long-term availability of government online publications produced in the digital environment. To this end, this study established the explicitness of the subject of regulation, the entities obligated to deposit and the strength of the norms, the authority of managing agencies and means of ensuring compliance, and the current status of the system’s operational structure as analysis criteria, and compared and analyzed the laws and regulations related to the deposit of government online publications in major foreign countries and in Korea. As a result of the analysis, the main areas for improvement were identified as the legal explicit specification of government online publications, clarification of the entities obligated to deposit, strengthening of the strength of norms, legal establishment of the authority and responsibilities of managing agencies, provision of effective sanctions and means of ensuring compliance, and the reorganization of the system’s operational structure.
