The Determinants of the Introduction of Soft Law Regulation: The case of Basel Accord

ABSTRACT

This study analyses the factors that affect the application of Basel Accord in global regulatory governance. This analysis aims to identify the determinants that play role in the introduction of the soft law regulation. With the case of Basel Accord established by Basel Committee on Banking Supervision, the analysis conducted with data of 81 countries by utilizing logistic regression. The results can be summarized as follows. First, it reveals that the countries have higher level of social globalization also have high possibility of introducing the Basel Accord. Second, it shows that the countries have more advanced system in law and institution will have significant impact on applying the regulation. Third, in terms of the macro-economic conditions, the economic freedom in the business sector affects the introduction of the regulation. Therefore, the results imply that the countries that are more globalized, have more advanced legal and institutional systems, and have more freedom in the business sector will adopt the regulation.
