A Study on the Governance of Regulatory Reform Implementation in South Korea

ABSTRACT

This study seeks to critically examine the trajectory of regulatory reform in South Korea, which has been consistently emphasized across administrations, and to propose future directions for improvement by systematically analyzing the institutional frameworks, instruments, and processes of regulatory reform under each government. The findings indicate that the regulatory reform framework has predominantly evolved under state-led initiatives, underscoring the need to enhance its institutional independence and technical expertise, as well as to establish a robust mechanism for mediating regulatory conflicts. The tools and processes of regulatory reform can be broadly categorized into the reform of existing regulations and the reform of newly introduced or strengthened regulations. Regulatory Impact Analysis (RIA) presents key challenges, including the need to ensure the effectiveness of cost-benefit assessments and to expand both their scope and methodological application. The regulatory sandbox system was found to require the timely completion of regulatory revisions within the designated experimental period to achieve intended outcomes. Regulatory conflicts call for the urgent establishment of deliberative procedures, mechanisms for consensus-building, and mandatory implementation of agreed-upon outcomes. Current practices for stakeholder engagement primarily emphasize the submission of opinions by regulated entities or subject-matter experts. This indicates a pressing need to enhance user accessibility by supplementing existing procedures with interactive dialogue formats and by integrating the management of opinion-gathering platforms to facilitate more effective conflict resolution.
