Philosophical analysis on Confucian Constitutionalism in contemporary China

ABSTRACT

This paper analyzes discourse of 'Confucian Constitutionalism' in Neo-Confucianism in China. Scholars who argue Confucian Constitutionalism aim to criticize and overcome the theory of Neo-Confucian scholars in HongKong and Taiwan who tried to make modern interpretation of Confucianism in the 20th century. In addition, they are trying to reflect the ideology of Confucianism into institutions and laws based on Political Confucianism and Institutional Confucianism. The claim of Confucian Constitutionalism proposed by Jiang Qing is the radical Confucian Constitutionalism in a form of unity of politics and religion. In this regard, Joseph Chan and Yao Zhongqiu assert their own moderate Confucian Constitutionalism as criticizing and modifying Jiang’s theory. The purpose of this paper is to explain the theory of Confucian Constitutionalism and to examine meaning and limitation of it.
