AB - 本文对 “保证人惯例”上的保证责任与保证关系、制度化试探与局限进行了分析。保证人的保证责任所具备的社会意义和威力实际上很是严肃且重大。因保证责任非常严重，使得保证人无法不时常对被保证人予以关注，与保证有关的事项即便发生细小的变化，保证人也能撤销保证。 保证的主体可分为人保和铺保，承保的个人(人保)多为以父兄为首的亲属或情份亲厚的熟人，涉及大额往来的商业交易则大多由有能力承担此责任的殷实商家来作保(铺保)。无论如何，因保证责任极为严重，保证人和被保证人在社会上只能是一种非常密切的关系。保证人和被保证人的人格关系很好地展示了极大影响中国人社会生活的血缘、地缘、业缘和学缘等社会网络的一个侧面。 很显然，如此传统的 “保证人惯例”至民国时期仍得到相当程度的持续，且有必要在这一持续当中确认其近代以后发生变化的契机或可能性。与此关联，本文对 “保证人惯例”在社会上的认识进行了分析，虽然存有部分对 “保证人惯例”弊病所提出的问题，但社会上认为 “保证人惯例”实属必要的观点仍然占了上风。 实际变化的契机或可能性表现在试图将 “保证人惯例”制度化的试探上。与 “制度化”关联，作者首先确认了近代以后出现的 “新式机关”的《保证规则》。《保证规则》对保证人的资格和责任、对保证人的确认调查(对保)、换保和退保等做了极为苛刻的规定，欲严格管理和运营 “保证人制度”。换而言之，在强化传统的 “保证人惯例”的同时所做的 “制度化”，即可说是 “被强化的保证人惯例之制度化”。 本文接下来确认了民法中与保证人相关的条款，可见其欲保护保证人权利――尽管只是一部分权利――的变化，同时宽泛地认可例外情况。就其结果而言，导致 “保证人惯例”发生质变的盖然性并不大。 最后，本文将 “中国第一保证保险公司”和《特种现金保证办法》作为制度化的例子进行了分析。这是一种通过团体或组织承保的方法，为了摆脱个人承保的弊端，被寻求而出。但由于两者皆需支付相当的费用，因此几乎未受到响应。若使用原有的 “保证人惯例”则无需承担任何费用，因此它们无法被人们轻易接受。可见应用 “关系”这一 “社会资本”既不产生费用且将确保交易安全性的 “保证人惯例”之影响力依旧优势如前。
