ABSTRACT

This study aims to study empirically the factors of effectiveness of co-regulation and to suggest measures for more utilizing co-regulation in Korea. The meaning of co-regulation is the regulatory modes that share to regulatory roles and cooperate between government and self-regulation organizations(SROs) for gaining a public goal. In co-regulation system, government gives legal bases and SROs are mid-actors that regulate actually regulatees. In this study, we find that it increases the effectiveness of co-regulation as increasing level of governmental interventions, SRO’s influences, and NGO’s influences in co-regulation system. We make the following suggestions for more utilizing co-regulation: ① to establish a role sharing system between government and private sector in perspective of regulatory governance. ② to search measures for effectiveness of co-regulation. ③ to introduce sound SRO’s filtering and supporting systems. ④ to make sure SRO’s publicness, independence, and transparency. ⑤ to enlarge participations of NGO’s in their decision making and implementation of co-regulation.
