ABSTRACT

Representative democracy bases on the principle of a popular sovereignty. In most modern countries, representative democracy opens a gate for accessing the people to the political process through an election. By characteristics of that the right of political decision has to be delegated to elected politicians, in substance the People have no chance to expert their political effectiveness. The principle of popular sovereignty is confined to one political formality. This thesis analyzes a distorted political representative system that it is excluded the people in a political processing and proposes a deliberative democracy theory, as an alternative. Especially in Korea, there is a Constitutional Court that decides against the President and the National Assembly, so it must be replaced the Civil Assembly. As it do, it is the first step toward a remaked but new democracy that all the people can be represented.
