ABSTRACT

Judging software infringement or similarity requires highly technical fact-finding, so software forensics in litigation is a form of expert appraisal. Now centered on public institutions, it cannot keep pace: rising caseloads and technical diversity leave courts without timely appraisals and bound in practice by one. As expanding public capacity is no cure, this study calls for widening private appraisal already used in trials and, to ensure reliability, proposes provider accreditation, standardized neutral methods, respect for accredited appraisals, and a legislative basis.
