ABSTRACT

The study is designed to take into account the ethical problems which the conceptual issue of death with dignity has and then shed light on the problems hidden in the establishment and revision of the laws on death with dignity from the perspective of Foucault's biopolitics. Besides, this study analyzes the process for revising the "the patient's decision to hospice, palliative care and dying process act law(It is so-called well-dying law)" and then argues that the well-dying law takes a utilitarian position rather than the ethical position. To access these issues, the main concepts of the law on death with dignity will be researched, and the difference in the concept between the death and the dying will be analyzed. Based on these, the establishment and revision processes for the well-dying law are analyzed. Moreover, the problems of well-dying law are specified, relying on the discussions of the aesthetic Euthanasia. In conclusion, this study will show that the ultimate problems of the well-dying law are related to the mechanism of free production for the existence of liberalism and capitalism. Furthermore, This article finds out what is the essential problem to be considered in terms of the right selection for the dying.
