AB - 최근 공정거래위원회는 파생상품거래시 금융소비자의 신용위험이 발생하였더라도 상당기간 최고 없이 계약해지를 내용으로 하는 약관은 불공정하다는 추상적 내용통제를 하였다. 금융소비자의 신용유지의무에 대한 책임은 전체 금융거래의 안전성과 밀접한 연관성을 가지는 동시에 금융상품의 거래과정에도 영향을 미친다. 때문에 공정거래위원회의 신용유지의무 약관에 대한 불공정성 판단 및 판단기준이 가지는 의의가 크다. 공정거래위원회의 추상적 내용통제는 원칙적으로 문언의 의미를 심사하는 추상적 심사이나, 구체적인 시장상황이나 거래관행 등을 고려하고 있는 바, 파생상품 거래에 대한 구체적인 시장상황이나 거래관행 등에 대한 구체적인 검토가 보충되어야 한다.
