ABSTRACT

As the country entered the post-Cold War era in the 1990s, the issue of North Korean human rights became an issue that could easily become a political issue within South Korea. Policy toward North Korea was also divided into two perspectives: improving humanitarian issues through prior exchanges and cooperation between South and North Korea, and promoting human rights of residents through cooperation and pressure with the international community. The ultimate goal is that the North Korean authorities or residents themselves must have a level of sensitivity that complies with the human rights norms of the international community. This study starts from the imagination of applying the concept of transitional justice, which is used when trying to correct human rights violations by past authoritarian governments, to North Korea. First, in order to apply the transition period definition to the North Korean region, the scope and nature of the transition were distinguished, and then the characteristics of North Korea, which were different from those of the former Eastern Bloc countries, were examined. From the perspective of the Korean Peninsula, we sought to present a desirable direction for transitional justice in the North Korean region through the human rights violations that occurred in South Korea after the establishment of separate governments in North and South Korea and the implications for North Korea of ​​the transitional justice experience. For the sake of discussion efficiency, the concept of transitional justice in the North Korean region was limited to the measures introduced by the new government in charge of the North Korean region during the transition period.
