ABSTRACT

The purpose of this paper is to provide reference materials for the direction of AI policy, enforcement ordinance, individual laws to be enacted in the future, and the possibility of revision by examining the Basic Act on Artificial Intelligence according to the literature review method. The term ‘high-impact AI’ needs to be changed to ‘high-risk AI’, and the 11th content in the list order in Article 2, Paragraph 4 of the Act needs to additionally stipulate the part ‘possible to cause danger’. The ‘generative AI’ part needs to be supplemented with provisions to ensure its transparency and safety. The ‘AI promotion organization’ part needs provisions for organizations such as task forces. The ‘AI business operator’ part needs to be separately stipulated by distinguishing the responsibilities and obligations of AI development business operators and AI utilization business operators. The ‘penalty provisions’ part needs to have step-by-step regulations according to reasonable responsibilities. In conclusion, these contents need to be supplemented in the Basic Act on Artificial Intelligence.
