ABSTRACT

Internet-shopping agreements hold an important position in our lives nowadays. An internet-shopping agreement is not included in the typical contract ruled by the Korean civil law. However the most important factor of the internet-shopping agreement is a contract for sale. There have been some studies on internet-shopping agreements conducted by legal scholars. However those studies are concentrated on the matter connected with an Consumer protection law. This treatise deals with legal relation between the cyber mall and the consumer mainly. In this treatise I would like to advance a theory to regulate legal problems rationally arising from internet-shopping agreements. This treatise deals with the legal nature of an internet-shopping agreement, the formation of the internet-shopping agreement and the legal relation between the cyber mall and the consumer after one makes a contract with the other. A cyber mall(seller) has a right to replace products and/or services bought by consumer by other things in particular cases. A cyber mall(seller) is liable to supply products and/or services for the buyer according to the contract. In case products and/or services have a defect, the buyer can call for terminating the internet-shopping agreement, or can claim for compensation. A cyber mall is liable to protect the personal information of buyers. The consumer should pay for products and/or services bought by himself. Credit-card or electronic cash is used in cyber mall. The buyer should inform the cyber mall of changed facts such as new address.
