ABSTRACT

There have been some studies on the legal issues of the right to self-determination of personal information conducted by legal scholars. However those studies are generally concentrated on the matter connected with the public law such as constitutional law. This research deals with the right to informational self-determination of internet users from the standpoint relating to private law. The right to informational self-determination comprises the right of consenting to give personal information to internet service provider, the right of inspection, the right of correction, and the right of deletion of the personal information. In case the right to informational self-determination is infringed, internet users can make a claim for damage. They can demand compensation, and also can take measures to prohibit infringement.
