ABSTRACT

Without doubt, Korea is one of the leading nations in e-government, the process of governance in which all administrative information, including personal information, is digitized and processed through network systems. However, the fundamental changes brought about by e-government that processes personal information in the network of information systems also call for restructuring of social framework on the protection of personal information. Consensus of our society clearly demonstrated by the NEIS issue demands systemic and socially acceptable privacy protection and continued discussions have led to the draft legislation of the "Basic Act on Protection of Personal Information". Legislative system based on this act would not only provide the necessary systemic structure for the protection of personal information by providing clear definition of what personal information is as well as establishing a system for classification of personal information but also establish an independent supervisory commission with the expertise and authority to investigate, supervise, and provide judicial support under the Office of the Prime Minister. Clear systemic structure for the protection of personal information and supervisory commission that the public can trust will be an important step towards building trust between the public and nation as well as the building block of e-governance.
