AB - 이 논문에서 필자는 법률가의 직업적 정체성이 계속적이고 제도적이며, 합법적인 지식생산제도를 통해 구성되고 강회되어짐을 주장하려고 한다.
공식적인 법제도 및 법기관에 관한 이론적 분석을 통해 (예를 들면 법률상의 자격 시험, 시험 준비와 고시준비 과정을 갖고 있는 학교), 필자는 어떻게 법문화와 법률가 집단의 이해가 특히 대만의 법 사회와 같이 유교 사회 아래에서 수용되는 지를 살펴본다.
권력은 개인과 사회 계층들 간의 구조상 위치를 통하여 이해할 수 있다는 푸코의 견해를 따르고, 또한 부르디외에 의해 사용 되어진 “법적 분야”의 특성을 통해서 필자는 대만에서 주입식 문화, 합법적인 지식, 그리고 합법적인 문화 사이에서 그 역설적인 관계를 검토해 본다.
필자는 고시학원이 대부분의 법학도들에게 매우 중대한 역할을 수행하고 있음에도 불구하고 법학교육에 관한 논의에서 충분히 고려되어지지 않는다고 생각하여 고시학원과 비정규법학교육에 초점을 맞춘다.
본 논문에서 필자가 의도하는 것은 고시학원이 법률가의 정체성 형성에 의미심장한 영향을 주고 그 영향은 대만의 정규법학교육에 중대한 영향을 미치고 있다는 것을 입증하려는 것이다.
