ABSTRACT

Although Korea has entered the ranks of advanced countries in terms of economic size and technological competitiveness, the industrial accident rate is still the lowest among OECD countries, and serious accidents in underdeveloped countries occur frequently, especially in the construction industry. Of the 874 deaths from industrial accidents in 2022, 402 died in the construction industry, accounting for about 46%, and the accident death toll rate in the construction industry (1.61) is much higher than the average (0.43) of all industries. In particular, private construction works record higher orders, ready-made prices, number of accidents, and deaths than public works, but most private orderers have insufficient safety and health activities and lack of establishment of a safety and health system. With this awareness of the problem, this study shows that first, the accident death rate and fatality rate of private-order construction works are overwhelmingly higher than public works. Second, the imposition of obligations for contractors under the current Occupational Safety and Health Act and the regulation of prohibiting and approving contracts that are ineffective cause legal confusion and inefficiency. Third, despite the enforcement of the Serious Accident Punishment Act, the lack of clarity of responsibility for the person placing an order causes passive safety and health activities of some private orderers. Fourth, the key factor in promoting worker safety and health was analyzed as 'workers' participation in safety and health activities'. Based on this, we clarify the responsibilities of the client, improve the legal system reasonably, and suggest integrated measures to spread safety culture.
