ABSTRACT

This study aims to examine the institutional limitations of the current system for protecting victims of stalking crimes and to explore the public-interest role and potential of private investigators as a complementary alternative. Although stalking is a high-risk crime characterized by repetition and persistence, existing institutional frameworks and public authority responses reveal structural weaknesses in providing long-term, continuous, and victim-centered protection beyond initial interventions. To address this issue, this study adopts a literature-based approach to analyze the causes and types of stalking crimes, as well as the institutional gaps that emerge during the case-handling process. Based on this analysis, the study examines the roles that public interest–oriented private investigators can perform within the victim protection system. The findings suggest that private investigators can function as risk managers for victims, supplements to existing protection mechanisms through systematic evidence collection, providers of physical protection and monitoring, and responders to cyberstalking. Rather than replacing public authority, private investigators can serve as cooperative public-interest actors who enhance the continuity and effectiveness of stalking victim protection systems.
