ABSTRACT

This article intends to analyze the characteristics and determinants of the labour market regulations for the employment protection of Korea. The Korean government has enacted laws for raising the level of protection for temporary workers in 2007 with aims of alleviating inequalities among workers, which is one of the remarkable actions of the government in the context of global flows of de-regulation of labour market. This research is to find the contextual meanings of the regulations for employment protection by comparing the regulations of Korea with those of OECD countries. According to the overall findings of the empirical study, it appears that the level of regulations for temporary workers is not the cause of the spread of the temporary employment in that the countries including Korea who have a higher level of the regulations show a higher portion of temporary employees among all employees. Also, it appears that regulations for employment protection are a result of the strategic choice of the Korean government with a weak informal protection system supported by a trade union, social protection for the unemployed and active labour market policies.
