ABSTRACT

Sexual crimes using fake videos such as deepfakes result in indiscriminately synthesized pornography being distributed and mistaken for fact. In particular, it carries a new risk in that it causes irreparable damage to the victim's reputation and privacy, even if there is no direct violation of the victim's body. Accordingly, the Act on Special Cases Concerning the Punishment of Sexual Crimes was revised to strengthen punishment for deepfake crimes and protect victims, but the incidence of deepfake-related crimes is increasing, raising the need for preemptive countermeasures. This paper attempted to identify various and complex deepfake-related crime types through prior research and review of foreign legal systems and provide a legal and institutional basis for embracing these types. In addition, measures such as fostering professional investigative personnel and strengthening international cooperation to ensure the efficiency of the investigation, strengthening a dedicated organization to rescue victims, and education on the prevention of deepfake sex crimes were proposed.
