ABSTRACT

This study analyzes the legal structure of the ‘Regional Specialized Visa (F-2-R)’ system, introduced to address local depopulation, and examines the practical effects of the ‘Korea-Vietnam Social Security Agreement’ on the establishment of settlement status and social fundamental rights for Vietnamese migrant workers. The F-2-R visa represents a shift toward a settlement-based migration model that incorporates migrants as community members, granting them status as prospective permanent residents. However, the strict obligations of five-year residency and employment in specific sectors may restrict constitutional freedoms of residence and occupation. This paper identifies the Korea-Vietnam Social Security Agreement as a key mechanism for materializing ‘legal rights’ in response to administrative constraints by protecting lifelong social security rights through the prevention of dual pension contributions and the totalization of coverage periods. In conclusion, this study proposes legislative policy alternatives, such as closing gaps in health and employment insurance, introducing the principle of change in circumstances, and enhancing bilateral administrative cooperation to establish a sustainable settlement model.
