ABSTRACT

This study analyzes the “algorithms of exclusion” embedded in administration and the counter-praxis mobilized against them, focusing on 2025 retrospective dispositions by the Korean Artists Welfare Foundation against Zainichi Korean artists residing in Korea. Using participatory research, it identifies an “institutional asymmetry”: the state includes them based on residence when imposing duties such as military service and taxation, yet excludes them from welfare rights as overseas Korean nationals. Solidarity between the affected artists and the author led to withdrawal of the dispositions. In March 2026, the Seoul Administrative Court dismissed the suit but ordered the Foundation to bear all litigation costs. Yet the withdrawal remained a discretionary “flight from meaning” evading judicial accountability. The Ministry of Culture, Sports and Tourism obscured the issue by presenting the parties’ counter-praxis as voluntary administrative reform. These contradictions constitute structural violence against Zainichi Koreans. Formed through colonial displacement before resident registration began in 1968, they require reform to restore civic status and rebalance rights and duties.
