ABSTRACT

Modern Administration is required to perform from the formation of social infrastructure to the national houses. Its aim for national welfare is inevitably required to perform many public utilities. Generally performing these public utilities is substantial to acquire land. Acquiring land for public utilities is not only by contract but also by compulsory expropriation. By the way, when the acquired lands for public utilities become useless even if those are acquired either by contract or by compulsory expropriation, those lands must be restored to original property. This is the Redemptive Right. And this article is written about the Redemptive Right to the Expropriated Land on the Korean statutes in force.
