AB - This research is carried out for the purpose of promoting the environmental right and the problems and improvement plan for the management and recycling of construction waste.In the present study, the problems and improvement plan for the management and recycling of construction waste have been investigated. Landfill is its popular disposal plan at the moment. However, it is required to increase its recycling portion because it is difficult to select a new landfill site. For this, the correct information for the produced amount of construction waste, its recycling amount, etc. should be obtained and the disposal cost system by types of construction waste has to be fixed. It is therefore necessary to improve the existing process and system for the understanding of an actual condition of construction waste production. Additionally for the higher recycling portion, it is suggested to recommend to use regenerated aggregates after the quality standards for them have been determined.(주제어) 환경권, 집단소송, 원고적격, 환경정책기본법, 프로그램규정설, 추상적 권리설, 구체적 권리설,불완전한 구체적 권리설, 헌법적 위임설, 폐기물관리법의 문제점
