AB - This paper aims to explain the reason of inconsistency between budget and legislation. This study aims also to suggest several directions for reform of current legal systems. Main Ideas of this paper comes from recent Issues of reform in the public finance law(the organic budget law and several related laws etc.). To reduce the inconsistency between budget and legislation, it is required to activate the cost estimates for Bills in the legislation process. The importance of cost estimates in the legislation process increased in korea after the IMF-crisis. The cost estimate ist today much more required in congressional legislation process as governmental legislation process. The legislation process must be adjusted with budget process. And also the Function of standing committee in National Assembly must join that of the Special Committee on Budget and Account. It is important, the constitutional relationship between Government and National Assembly on more sound and stronger basis to establish. This paper will guide korean government additionally how to increase tansparency, effectiveness and soundness of the korean public finance.
