ABSTRACT

Recently legal disputes occur frequently respect to compensation for losses with execution of public works. Also, the resulting in social impact is getting bigger and bigger, current situation is more serious. The reason for current situation is the theoretical research of compensation and legal system is not reflect reality. The current Compensation system is need the theoretical research and improvement of the legal system for just compensation, One of the these is compensation for livelihood compensation. Livelihood compensation is one recently discussed important issues. About the necessity of the compensation is generally consistent with the views and relevant laws and regulations have been about the livelihood compensation. However, the provisions is not enough to full compensation for execution public works service in many parts. Theoretical studies about the concept and scope for livelihood compensation is not sufficient. For this reason legislation has failed to reflect sufficiently. Because of the scope and requirements of livelihood compensation are limited recognized by law, the victim is not compensated enough. In this regard, theoretical review is required to the concept and content, limit of compensation for livelihood compensation, and improvement is required. This paper research on South Korea's Compensation for living rights and other country's livelihood compensation, such as UK, USA, Germany and Japan, to improve our system by way of legal compared.
