ABSTRACT

There are Administrative Vicarious Execution Act and National Tax Collection Act as general laws in related to Administrative compulsory execution in our nation. But because Enforcement Fine doesn't have any general law, it has been exceptionally admitted if only an individual law allows it. Incomplete legislation system and legislation deficiency on Administrative compulsory execution have caused difficulties. Therefore, we need legislation to improve this actively. In order to solve these problems, it is urgent that Administrative execution act as a basic law on Administrative compulsory execution or a general law related to Enforcement Fine should be established. The laws introducing Enforcement Fine have increased steadily since it was adopted by Building Act in 1991, reaching 27 now. Also, related government sectors for Enforcement Fine have been rising and it will be continued further. Meanwhile, not only the number of Enforcement Fine imposition but also the amount of imposed mony by it have raised every year. This shows that there is necessity and effectiveness in Enforcement Fine. Furthermore, this explains that the establishment of general law for it is appropriate and reasonable. Accordingly, this article stresses that the legislation for Enforcement Fine is necessary and urgent, and also describes considerations when the law is established.
