ABSTRACT

The Law on the Venue of Cooperation between the State and Provinces” which was established and is currently in force has a probability to become a means for solving inconveniences in communication with respect to the administration of state affairs that local governments have had so far. Main contents of the law is that the state and local government handle “matters on the role allocation between the state and local government”, “matters on the local government” and “matters considered to have an influence on the local government amongst national policies” by mutually consulting. There is a possibility that the state and local government can make progress relationship from top and bottom to the cooperative relationship if they use the law in control. However, issues selected through mutual consultation between the state and local government shall not remain as the ones demanding or asking to the state, or the ones to win a local government to consent to the policy decided by the state unilaterally. Currently, a law similar to “The Law on the Venue of Cooperation between the State and Provinces” of Japan has been submitted to the National Assembly, and this thesis was prepared to obtain implications for the laws of Korea by examining the details of enactment and main contents of Japan‘s “The Law on the Venue of Cooperation between the State and Provinces.
