ABSTRACT

The management entity is regulated in the Act on the Ownership and Management of Condominium Buildings or the Housing Act. In the control body of the Act on the Ownership and Management of Condominium Buildings, the management of collective buildings has in the collective building control group comprised of sectional owners of building and In Housing Act, It defines the management of apartment housing in resident representative meeting by stipulating matters concerning the management of apartments. Like so, the existing structure of current law consists of a management body in condominium buildings but the apartment building is comprised of resident representative meeting. Therefore, there are two groups of organizations in a single building. So, the existing law is said to be a dual law framework for managerial bodies. In addition, there is no rule concerning the qualifications of custodian. If a manager lacks professional expertise, the administrator's task is not to be handled efficiently and smoothly in the Act on the Ownership and Management of Condominium Buildings. Thus, it is necessary a clear rule for keeper and managing body, managing managers as custodian, managing management bodies, It is necessary to strengthen the qualification requirements of the managing body, along with measures that are compatible with each other. In addition, to address the dual issue of the management entity, for unification of the Act on the Ownership and Management of Condominium Buildings and the Housing Act, it is necessary new Administrative Law on a management of Apartment house and an incorporation of management body for transparent and reasonable management oversight.
