ABSTRACT

The purpose of this study is to investigate the Innovation of Urban Architecture in Seoul, that is stipulated the Innovation of Apartment Improvement Projects and Urban Architecture. To research the legal ground of the Innovation of Urban Architecture in Seoul, I reviewed the Public Management of Rearrangement Projects on the Act on the Improvement of Urban Areas and Residential Environments, and the reason of alteration of that article. The name of identical article is changed from the Public Management of Rearrangement Projects to the Public Assistance in Improvement Projects. And I studied the contents of that Innovation and the problem of that Innovation and proposed the solving method of that Innovation. That Innovation of Seoul was made for the future 100 year’s landscape of Seoul. Because the 56% of Apartments of Seoul should be rearranged until 2030. As the decision maker of Urban plan, Seoul Government has planned to assist the civil rearrangement of apartments, and induce the owners of apartments to the three-dimensional architecture design and enhance the effectiveness and transparency of that business. Because the business of rearrangement Projects is basically the exert of property right, the influence of that innovation of Seoul to them remains concern. If the apartment complex has the problems, it is basic for the owners of apartments and the project operator for rearrangement Projects to make the best reasonable proposal for the public goods. They have to resolve many problems of rearrangement Projects. Probably that innovation of Seoul officer could make the lower effectiveness than civil decision. If the owners of apartments has not adopt that innovation of Seoul, Seoul Government can not force to implement its decision. That innovation of Seoul for future Seoul is going into effect in some area of Seoul, it is not easy to make an early estimate of the effect because of beginning enforcement. To make the construction of future Seoul, that innovation of Seoul must be accord with the owners of apartments. The legal nature of the Innovation of Urban Architecture in Seoul is not administrative plan but administrative guidance, so it does not restrict citizen but guide the citizen’s decision of the Apartment Improvement(rearrangement) Projects and Urban Architecture. the Apartment Improvement(rearrangement) Projects is the problem of dwelling and property right.
