ABSTRACT

This study addresses the issue of the intermingling of religious law and civil law within Islamic jurisprudence. It also posits that separating religious law and civil law guarantees greater religious freedom. Currently, in South Korean society, there is a perception of Islam primarily associated with terrorism, and Muslims are often stigmatized as terrorists. This perception is a result of the convergence of religion, politics, and law, leading to the ideology of 'religious totalitarianism.' In contrast to 'religious totalitarianism,' there is a growing demand for Islamic democracy, which has prompted reform movements within Islamic nations to separate religion and politics. This research explains the concept of secularization and the principle of separating religion from politics (laïcité) within Islamic law. From a Christian ethical perspective, the separation of Islamic law from Islam should be viewed as contributing to peace and coexistence in human culture.
