AB - This paper was written for the purpose of parparing for the basic foundation in family succession in the late Joseon Dynasty by synthetically considering ‘Gyehu deungrok’. It was published by the Ministry of Culture and Education in order to be used as a future reference, from recording facts of adopted sons permitted from the country and relevant facts discussed at the Royal court. The existing ‘Gyehu deungrok’ is applicable to the 17th~19th century, about 15,000 facts of adopted sons are recorded. These are divided into ‘Gyehu deungrok’ and ‘Byeol-gyehu deungrok(supplementary registration document of adopted sons)’. There is the character that they were owned by Gyujang-gak(royal library) and Jangseo-gak(national archives) separately according to the contents.
Along with the purpose, this study re-examined the concept and types of ‘Beop-owe Gyehu (adopted sons outside the law)’ derived from the contents of ‘Byeol-gyehu deungrok’. ‘Beop-owe Gyehu’ was understood as the character of operation of the empress sytem of the late Joseon. But, there was a problem that the criterion was restricted to ‘Gyeongguk daejeon (complete code of law that comprises every law, acts, customs, and ordinances)’. It is necessary that the type is also to be arranged to a consistent criterion. Moreover, since there is an aspect that the meaning of outside of the law is changed according to times, the meaning should be considered along with systematic change and social emotions in the late Joseon Dynasty.
