The Characteristics and Resolution Mode of Korean Public Disputes: Focussing the Cases that Government Got Involved as a Party

ABSTRACT

This study aimed to examine the characteristics and resolution of public disputes that government got involved as a party. The results showed that ‘government/nonofficial group(g/ng) disputes’ occurred more frequently than ‘nonofficial group/government(ng/g)’ and ‘government/government(g/g) disputes’. Second, government-involved disputes occurred most frequently in the period of Lee Myung-bak administration, followed by Roh Moo-hyun, Kim Dae-jung, Roh Tae-woo, Kim Young-sam administrations. Third, ng/g disputes occurred most frequently in Roh Moo-hyun administration, g/ng disputes in Kim Dae-jung administration, and g/g disputes in Lee Myung-bak administration. Fourth, class disputes accounted for the highest number of ng/g and g/ng disputes, regional disputes accounted for the highest number of g/g disputes, interest/interest disputes accounted for the highest number of ng/g and g/g disputes, and interest/value disputes accounted for the highest number of g/ng disputes. Fifth, civic organizations got involved in g/ng disputes most frequently. Next, the results of dispute resolution showed that ng/g disputes were resolved most fre quently by negotiations, and g/ng and g/g disputes by administrative orders. Second, the average duration of disputes was shortest at ng/g disputes, and longest at g/ng disputes. Third, the average duration of disputes lasted longer when civic organizations got involved in.
