ABSTRACT

There exist numerous remaining questions, such as structure of appellate mechanism and the relation with the courts, which need to be resolved. The purport of it is, if a defendant has shown a positive attitude a plaintiff's claim to protect his interest that the dispute against the plaintiff should be settled by judgement in this opportunity of the suit and the activities during the defense should not be meaningless. We have discussed about establishing an appellate court in each province. Setting up a new appellate system will help people appeal against an instant court decision freely. It will improve the appeal right and the access of the judicial service. It engenders the decentralization of judicial power, implying judicial independence. We are aware of the fact that the independence of the judges had been threatened by the judiciary itself, which had become more and more bureaucratic. Courts have made efforts to revitalize civil mediation and achieve more or less good results according to the courts. By increasing the number of judges, the workload pressure per judge would be lessened, creating desirable conditions for a judge to put in time and efforts necessary for each case and thereby, in the end, contributing to enhancing the consent on court rulings or reducing the appeal rate. The mediation procedure is very useful for solving civil disputes.
