ABSTRACT

France is a leading country that institutionalized the modern private investigation system and has a comprehensive legal framework across the definition, qualification requirements, education, and supervisory system of private investigation. This study compares and analyzes the French private investigation system and the Korean private investigation system to reveal the differences in the process of introducing and establishing the system, and to derive implications for the development of the Korean system. To this end, focusing on 「French National Security Code(Act)」 enacted in 2012, the private investigation system in France was analyzed and the institutional status of Korea was compared. As a result of reviewing the legal structure, practical role, public awareness, and level of integration within the private security industry from various angles, it was confirmed that there are distinct institutional differences between the two countries. Through this comparative analysis, this study aims to present legal and institutional tasks for the development of the Korean private investigation system and to provide basic data for policy discussions on the direction of institutionalization in the future.
