ABSTRACT

This study aims to analyze the illicit activities of pseudo-media within Korean society and explore effective countermeasures utilizing private investigators. To this end, the study conceptually defines pseudo-media and confirms, through literature review and analysis of court rulings, that pseudo-media causes multilayered social damages, including the erosion of corporate competitiveness, erosion of journalistic credibility, obstruction of legitimate decision-making processes among citizens, and dissipation of administrative resources. The current public response systems, centered on the Press Arbitration Commission (PAC) and the Korea Communications Standards Commission (KCSC), were found to have limitations as their remedies are purely ex-post in nature and lack binding force. Consequently, based on a comparative analysis of overseas cases, this study derived a systematic investigative process consisting of six stages that private investigators can perform: Initial Assessment and Verification of Victimization, Digital Forensic Investigation Based on OSINT, Field Investigation, Investigation of Similar Victim Cases and Reputation, Establishment of Evidence Collection Strategy, and Preparation of Investigation Report and Legal Support. This study suggests that private investigators can function as a complementary social safety net by identifying the illegal activities of pseudo-media from a public interest perspective, thereby protecting legitimate journalism and realizing social justice.
