ABSTRACT

South Korea has recently strengthened its legal and administrative frameworks for child protection, notably through the 2020 amendment of the ‘Act on Special Cases Concerning the Punishment of Child Abuse Crimes’(the so-called ‘Jeong-in Law’). This system faces practical challenges, including a lack of specialized expertise due to rotational staffing, insufficient inter-agency cooperation, and limits on legal enforcement power. This study aims to identify structural limitations in the South Korean system and propose improvement measures by conducting a comparative analysis of child protection systems in France, the United Kingdom, Germany, and Canada. The study employs a literature review methodology to examine the legal foundations and operational characteristics of each nation. Based on these findings, this paper proposes four key policy improvements for South Korea; ① establishing independent, specialized child protection agencies to ensure long-term expertise; ② strengthening the effectiveness of judicial intervention in administrative decisions; ③ introducing an integrated multi-agency cooperation system similar to the UK's MASH; and ④ shifting the policy paradigm from punitive measures to family recovery and mandatory therapeutic intervention.
