ABSTRACT

This study analyzes South Africa’s private investigation system under the Private Security Industry Regulation Act (PSIRA) and compares it with Korea’s Bill on the Operation and Management of Certified Private Investigators proposed in the 21st National Assembly to derive implications for institutionalizing Korea’s detective system. A comparative institutional analysis reveals that South Africa has institutionalized registration, supervision, ethical regulation, digital evidence management, and cooperation with public law enforcement through an independent regulatory authority, whereas Korea’s bill provides a basic framework but shows limitations in enforceability and regulatory specificity. In particular, gaps are identified in the legal binding force of codes of conduct, the linkage between financial resources and supervisory capacity, and the formalization of digital evidence governance. The study proposes a phased legislative and implementation roadmap and strengthened public–private governance to embed private investigators as a complementary component of public security governance in Korea.
