ABSTRACT

This study aims to derive the direction of legalization and specific legislative tasks of the Korean detective industry by comparing the private investigation systems of Belgium and Korea. The main comparison criteria were the legal concept and scope of private investigations, entry regulation, supervisory system, personal information and privacy protection, relationship with public investigations, responsibility and sanctions. As a research method, Belgium’s 1991 Private Detective Vocational Organization Act, 2024 Private Investigation Regulation Act, related legislative data, administrative data, and personal information protection supervisory body opinions were analyzed, and a normative and institutional literature analysis was conducted to compare them with the Korean National Assembly legislation related to the detective industry, current restrictions, and previous studies in Korea. This study is meaningful in that it presented the institutionalization of the Korean detective industry as a matter of legal design that harmonizes rights relief, protection of basic rights, and public responsibility, not just job permission. However, Belgium's 2024 law has not accumulated enough actual enforcement cases, so empirical research is needed to analyze the operational cases of permits, supervision, and sanctions and stakeholder perceptions in the future.
