ABSTRACT

This paper attempts to empirically explain the meaning and influence of the language and behaviors of prosecutors through court monitoring. To this end, we analyze the attitudes of prosecutors by visiting the courts in Seoul, Gyeonggi, Gyeongnam, Jeonnam, and Jeju Island in person. This research uses the observation method among qualitative research methods and applies Erving Goffman's theory of impression management to the analysis. The third-party interpretation of verbal and nonverbal behaviors raises a question about what the essential roles of the prosecutor are. The attitudes of prosecutors are categorized into two ways: human rights-friendly attitude and trial performance capability. This paper argues that prosecutors have to understand each case in the broader social relations and contexts and put intentional efforts to protect the human rights of involved individuals.
