ABSTRACT

This thesis examines the structure and content of Heumseobaknon in order to clarify its relationship with Heumheumsinseo, and offers an overview of the criticisms and reform proposals regarding Choson criminal law presented in this work. The primary editorial intention behind Heumseobaknon was to criticize Heumheumsinseo, and in the course of doing so, it pointed out the fundamental five problems of Choson criminal law. Sim Dae-yun’s critique of Heumheumsinseo centers on these five aspects. Although Sim Dae-yun proclaims an antiquarian stance, in practice he relies on the Confucian classics as the basis for his arguments, and his theory of criminal law intertwines premodern and modern elements. Sim Dae-yun merely presented what he regarded as the best possible alternative, taking into account the concrete social conditions of Choson at the time.
