ABSTRACT

Recently, fake news has become a big problem in society. To regulate this in Korea, two bills were proposed by the 20th National Assembly, but all were discarded due to the closing of the parliament. However, Korea still sympathizes with the recognition that countermeasures against fake news are necessary, and the scope is also being debated. In France, when the 2017 presidential election, parliamentary and local parliamentary elections, and European Parliament elections were held, discussions were also held on the regulation of false information. Then, 「LOI n° 2018-1202 du 22 décembre 2018 relative à la lutte contre la manipulation de l'information」 was announced. This Act may give implications for the enactment or revision of the Act on the Regulation of Fake Information in Korea. First, France uses the terms 'false information' or 'information manipulation' due to the limitations and negative effects of the term 'fake news'. This is similar to the term ‘falsified information’ adopted in ‘A multi-dimensional approach to disinformation’ published by the European Union. Second, 「LOI n° 2018-1202 du 22 décembre 2018 relative à la lutte contre la manipulation de l’information」 prevents the negative effects of false information in advance in order to reflect voters’ intentions in the election without distortion. Specifically, transparency obligations were strongly imposed on online platforms.
